Transparency Still an Unfulfilled Promise by President Obama

The Obama Administration has already taken several laudable steps to separate itself from illegal policies and practices of its predecessor, and I applaud them for it.  I’m glad Attorney General Holder released some of the shocking legal memoranda prepared by the Bush Office of Legal Counsel, which authorized blatantly unlawful and unconstitutional acts by the executive branch.  But I choked a bit on Mr. Holder’s statement that “Americans deserve a government that operates with transparency and openness.”  I agree wholeheartedly, but I find this sentiment glaringly at odds with some of the Justice Department’s own recent actions.

In several pending court cases that began before President Obama took office, summarized by blogger Glenn Greenwald, among others, the Obama Justice Department has recently taken positions that appear to embrace the Bush Justice Department’s expansive view of Presidential power.  For example, in a lawsuit brought against the Jeppesen company, a Boeing subsidiary, by five alleged victims of “extraordinary rendition,” the Obama administration invoked the “state secrets” doctrine to keep certain documents out of the hands of the plaintiffs, with the apparent aim of depriving them of their day in court.  In this and other recent cases where Eric Holder’s Justice Department has taken similar positions, no administration official has bothered to offer any explanation for doing so.  So much for transparency and openness!  Yet these actions cry out for an explanation because, on their face, they are so conspicuously at odds with President Obama’s and the Attorney General’s own declared values and promises.

It’s beginning to appear that what we have is a President who disagrees with many of the specific policies and practices of his predecessor but who reserves the right to adopt them himself — or other, possibly equally illegal practices — if he feels the need in the future.  This should serve as another sad reminder of the need to ensure that honoring our obligations under domestic and international law is not left up to the whim of whoever happens to be our President at any given time.  A good first step would be a thorough investigation by an impartial panel of experts into all US government counterterrorism practices since 9/11, in a manner that enables criminal prosecutions to be undertaken where warranted.  Only by demonstrating that lawlessness has serious consequences can we ensure that whether we have a government that obeys the law does not remain a matter of Presidential preference.

  1. Did you honestly expect "transparency" from this man? If you voted for him expecting transparency the joke is on you. One doesn't have to look that far BEYOND the bumber stickers and rhetoric…but millions chose not to consider this man's character, shady politics, questionable judgement etc….

Put this on the long list of broken campaign promises and disappointments. You thought the last eight years were bad? I "HOPE" we can survive the next four.

  2. Mr./Ms. Nobama (how clever):
Are you just going to insult the President, everyone who voted for him and then HOPE that things will get better? Are you going to DO nothing to help the situation?
What, did YOU think that any President would be able to make a huge change without the rest of us? If you thought that, the joke's on YOU.
This kind of negativity and @#$%-it-all attitude is what's wrong with this country, not crooked politicians. We can do a lot more than vote and complain, can't we?

  3. Yes I am going to insult the President and anyone who voted for him. You should have seen this lifetime fraud (preelection) for what he is.

I'm doing my "activist" part don't worry. If things don't improve he's gone in four years and will soon start being judged on his policies and actions and less on his popularity. It takes alot more then "Not Being George Bush" to be the leader of this country. Folks forgot that…

    Good luck Johnny…

  4. Certainly there is more to being a good President than not being Bush. Clinton wasn't Bush, and I would not call him a good President at all. That fact does not take away from some of the man's strengths, however. I don't want to get into a debate on the merits/weaknesses of Obama, since neither of us is likely to change the other's mind, and that only focuses on some engineered fissure in the US that keeps us mad at each other and not at an ineffectual government.

But that you do more than write/talk is a good thing, even if the activism you and I do might be very different, if we believe our parties. (I didn't mean that to sound so condescending, sorry.)

  6. I almost never "blog" and even more rare "go-off"

Something about this guy brings out the worse in me. Sorry you were at the receiving end.

Yes I'm angry…my bad. I hope he knows what he is doing and I hope he follows through on some of his campaign promises.

Didn't mean to insult anyone's efforts.

Geez, it's a shame that civil exchanges like this are getting rarer and rarer these days.
    Best wishes to you:)

    He Says One Thing
    Thinks Another
    Means Another
    and Does Another

Will the real Barack Obama stand up?

  17. Okay, "We The People", its time we be just what we say we are "The People". Hope not to offend anyone only call you out "Nobama", I ask, Is it the talk that he talks or the actual color of his skin, that really makes us uncertain of his actual ability to "Lead" this country the way it was intended by "Our Forefathers!" I, ask this because, the words of total inspiration with leadership, that "Our President," speaks are exactly what I needed to hear to know what direction I needed to vote in to secure what I know from my "Forefathers" teachings that All Man Are Equal in the eyes of God with Life, Liberty and the Pursuit of Happiness!!!"

On that note, "Nobama", everything I've heard, has been straight up "Real Life, Liberty and Happiness, talk!!!!!

Not to even speak of his Beautiful Black Skin!

  19. Ali, while I agree with you whole-heartedly on what you say about how Barack is inspiring and while I personally find him inspiring also, implying that "NOBAMA" is skeptical of President Obama because of his skin color is a little unfair. He/she never said anything to that effect. I'm just saying. 🙂

  20. Sorry, I know him and he is a good man,he is for the little people like me and you,I think he will do the right thing for all of us.This name is Obama not NOBAMA THAT UNFAIR, SO WE NEED TO PULL TOGETHER AND SUPPORT HIM,he's the best thing we got right now.

  23. Ali-

It doesn't matter to me the color of his skin. What matters to me are his actions vs. his words. His actions vs. his campaign promises.

"Nobama" is a play on words. I'm sorry you are sensitive and this has somehow offended you.

Watch this country spiral further and further into debt, watch the economy continue to tank, watch unemployment continue to rise all because of a stimulus plan that will have a negative impact, watch the same-old-same-old in Iraq policy, watch campaign promise after campaign promise vanish and then tell me how great he is.

I'm "a little people" just like you…UNLIKE you I see past the color of this man's skin. It was YOU that said "Not to even speak of his Beautiful Black Skin!"

Enjoy the euphoria while it lasts and welcome to the period of a welfare not prosperous nation.

  24. What he promised:

    – TRANSPARENCY (LIE)
    – NO LOBBYIST APPOINTED TO CABINET POSITIONS (LIE)
    – NO MORE WASTEFUL SPENDING AND HE WOULD GO LINE BY LINE ON LEGISLATION, PUSHING SPENDING BILLS WITH WASTEFUL SPENDING OR EARMARKS BACK TO CONGRESS (LIE)
    – HE PROMISED 5 DAYS FOR PUBLIC TO VIEW LEGISLATION BEFORE HE SIGNS THINGS IN TO LAW (LIE)
    – HE HAS ADOPTED PRESIDENT BUSH'S SAME IRAQ POLICY AND HIS WITHDRAWAL PLAN MIRRORS THE SAME ONE BUSH HAD (LIE)
    – CREATE OR SAVE 3.5 MILLIONS JOBS??? NOT THE WAY HE AND CONGRESS ARE GOING AT IT HE WON'T!! (LIE)

WHAT IS IT YOU LIKE ABOUT HIM AGAIN? OH YEAH, HIS INSPIRING WORDS.

    GOOD LUCK

  27. Send him a E-mail and let him know how you feel and yes he has inspiring words.I thank that you are one of the people that is mad because he won and people like you sat back for 8 years and let Bush put us where we are at today and he really lied to the American people.

  29. Inspiring words IS ALL HE HAS.

Go on believing in your messiah as the economy tanks. I'm no fan of Bush either…but I was smart enough to know that George Bush wasn't on the ballot for 2008…and that is exactly how Obama got elected.

The RESULTS will speak for themselves…keep getting "inspired" by the words as the economy and prosperity in this country continue to crumble. President Obama inherited a mess the equivalent of a kitchen fire, his solution is to add fuel to the fire and dump gasoline on the entire house.

Don't take my word for it…watch and learn. 2012 will hopefully come soon.

  30. I send him and like minded lawmakers plenty of e-mails and will continue…

However, they seem to be falling on deaf ears. History, Facts, and previous outcomes of the same economic policies all point to disaster.

    Wake up.

  33. Ali-

Thanks for the offer, but no thanks. You do your thing, I'll do mine.

I'm against 90% of what President Obama stands for (to inlcude a move away from individual responsibility and SPREAD THE WEALTH).

For example, 1% of the taxpayers pay 40% of all tax revenue. 32% pay ZERO or in many cases get back more then what they pay in. That's enough "spreading the wealth". And no…I'm no where near the 1%. Anymore "spreading" and you begin to punish success and punish corporations, the economy goes south, people lose jobs etc….

This is not the way to save our country and save our economy. He and like minded individuals refuse to learn lessons from history and refuse to listen otherwise. Hell bent on spreading wealth, taking from those who've earned it and giving to those who haven't. Hell bent on spreading wealth regardless of the consequences. And as far as that Stimulus bill it was a complete joke. People should really read the garbage that is in there. 2010 will be a fun year in Congressional Elections and 2012 will be even better.

Good luck Ali, please refrain from suggesting racism when one challenges President Obama's policies. You do more damage and slow the continued progress of race relations. This is 2009, not 1965. Everyone has an equal opportunity to succeed PRESIDENT OBAMA is a perfect example.

  34. I am not using racism,I am using facts from the history of this country which was founded on racism, yes the wealth should be spreaded around because the 1% you are talking about got tax cuts from BUSH and the working people paid more taxs, the corporations got richer off of the backs of the working people.Check your history and have a good day.

  35. You used racism when you suggested my beef with Obama was about the color of his skin.

EVERYONE got tax cuts from Bush FACT.

Under Bush 1% paid 40% of all tax revenue FACT.

Under Bush 32% paid 0 tax revenue or actually got back more then they had paid in FACT.

Check IRS website for the facts, don't take it from me.

As far as history, study what caused the great depression and then try to deny the current Congress and President aren't following the same failed plans that caused the great depression. Study Japan's economic crisis of the early 90s that they are still trying to dig out of today.

    OHHHHH – BAAAAAAHHHH – MAAAAAAAH

You have a good day to.

  36. After you are done with History, do some Math.

ASSUMING the stimulus "saves or creates 3.5 million jobs" (which it won't anyway) Consider the FACT that the stimulus was $875 BILLION (before years of interest and amount added to our debt).

That equals $250,000 per job "saved or created". Do these jobs average $250,000? I don't think so.

Millions of people have been sold a bill of goods.

    OHHH-BAAAA-MAAAA….OHHH-BAAAA-MAAAA

refusal to work with other people, the whole you do your thing i'll do mine is what's wrong with the right/reps these days.
you lost. we won. deal with it.

  44. And I will say once again ALI, I'm no fan of Bush…if he had somehow been allowed to run for a 3d term I wouldn't have voted for him either.

It is funny how you don't challenge my FACTS, you just attack me.

  45. In the first 50 days of this administration MORE money has been spent then the entire 7 years in Iraq.

Speaking of Iraq, what are we still doing there? Why the 180degree turn? Isn't Obama the Commander-In-Chief Now? He Won alright…so why is he following the same Bush plan for the exit strategy?

What happened to the inspiring words he told us during his campaign about Iraq? What happened to the "steadfast" Senator Obama who voted against funding the Iraq war because it wasn't pulling the troops out fast enough?

I hope you all get angry and hold his feet to the fire…but it's likely he'll just give another one heck of a speech and you can continue your crush on him.

Good luck, enjoy the welfare nation and Socialism COMRADES.

    I'm ROFL as well.

Can't argue facts so you resort to being like a second grader.

I guess the anti-war protestors should have just "gotten over it" cause George Bush won the election and wanted war in Iraq. Those who didn't want the war "lost" they should have just gotten over it.

Well if that is the best you got…that is the best you got. I for one won't "move on" and let me country tank. He'll change course or he will lose in 2012.

  51. It looks like this blog is a shooting contest between Nobama and Ali. Is there anyone else out there? I would dimsiss Ali's arguments since he is still in the denial stage of euphoria. It will pass OK. Just takes some time. As for Nobama, you are fine with your arguments, but there is no point arguing with a zealot who is praying to a Messia. The irony is that he is no Messiah but a very inexperienced but talented individual who was able to trick 55% of the country into his "ideas" that most of them not on a table anymore. What is left is a drive to tank this country into a welfare state. I hope he does not realize this, otherwise I would think that he is a "Manjurian Candidate." Bush helped to elect Obama, now we are going to pay for mistakes of both of them. Is there anyone out there who is sick and tired of mistakes? Can we for God's sake elect someone honorable who can keep his word? Talking from a teleprrompter is not an indication of management and sense of reality, just good education and talent. It is not enough to run the country like US. I am predicting that in 4 years there still will be the bilnd followers of the annointed one, but I am sure at least 50% of 55% of the country will regret voting for him. I did not vote fro Obama, but when he became a President I decided to give him a chance to lead and see what happens in a year (Maybe he was right on a campaign trail?). I got completely diallusioned in less then 60 days. What a shocker. I think the most important now that WE THE PEOPLE start having a civil and intelligent discussion trying to unwind what is happening with country instead of polarizing opinions and not finding any points of common agreement. If we cannot find common grounds, the country is doomed.
