Human and Immigrants' Rights Movement Reacts to Arizona Defiance

Amnesty International is extremely disappointed that Arizona Governor Jan Brewer signed into law SB1070, a bill that will significantly increase the likelihood of racial profiling, arbitrary arrests, and detentions in the state. By forcing Arizona police, the vast majority of whom opposed this law, to implement it or face lawsuits is bad policy and will drastically undermine communication between communities of color and the police who are supposed to keep them safe.

As the governor said when signing the bill, national immigration legislation is desperately needed, but the absence of it does not abdicate the governor’s own responsibility to preserve, promote, and protect the human rights of every individual in Arizona, whether citizen, resident, or visitor. Human rights exist regardless of nationality, ethnicity or immigration status. In passing SB1070, Arizona public officials have ignored this truth to the detriment of every individual who passes through the state.

  1. "Arizona defiance"? Are you saying a state who opts to enforce or bolster current laws are defiant? Defiant against what or whom, the law?

"….. a bill that will significantly increase the likelihood of racial profiling, arbitrary arrests, and detentions in the state. By forcing Arizona police, the vast majority of whom opposed this law, to implement it or face lawsuits is bad policy and will drastically undermine communication between communities of color and the police who are supposed to keep them safe."

Those are some strong assumptions and accusations. Does The Editor have verifiable facts to support what "might" happen? Also, "By forcing Arizona police, the vast majority of whom opposes" is incorrect as there were more Officers in favor than opposed including entire precincts and counties. Can you verify this fact you stated?

  2. Below please find a variety of statements by Arizona law enforcement opposing the bill:

    1. Phoenix, Arizona's mayor speaks out against passage of the bill:
    http://www.washingtonpost.com/wp-dyn/content/arti

"As an immigration bill that nationally embarrasses Arizona becomes bad law, our best hope in my hometown is that the rest of America doesn't do to Arizona what Senate Bill 1070 requires our police officers to do to people with brown skin: "profile" them based on stereotypes and insufficient information."

    2. Arizona's Attorney General opposes the bill:

    3. The press statement of the Arizona Association of Chiefs of Police opposing the bill:

AACOP STATEMENT ON SENATE BILL 1070

The Arizona Association of Chiefs of Police (AACOP) remains in opposition to Senate Bill (SB) 1070. The provisions of the bill remain problematic and will negatively affect the ability of law enforcement agencies across the state to fulfill their many responsibilities in a timely manner.

While AACOP recognizes immigration as a significant issue in Arizona, we remain strong in our belief that it is an issue most appropriately addressed at the federal level. AACOP strongly urges the U. S. Congress to immediately initiate the necessary steps to begin the process of comprehensively addressing the immigration issue to provide solutions that are fair, logical, and equitable.

Should SB 1070 be signed into law by the Governor of Arizona, law enforcement professionals in the State of Arizona will enforce the provisions of the statute to the best of their abilities.

    4. On April 20, 2010, Arizona Daily Star publishes information on the position of Arizona police chiefs and sheriffs – most oppose the bill:
    http://azstarnet.com/article_893afe6a-4d0e-11df-b

Law enforcement opposed to the bill in Arizona, as well as many other public officials, community organizations, businesses, faith-based, human and civil rights organizations have identified credible concerns about how the bill will be implemented – as it requires police to arrest and jail any person who is suspected of being undocumented who cannot prove on the spot with paperwork that she has the right to be in the country. Failure to arrest could result in lawsuits by private citizens. There is widespread concern, cited by all of the groups noted above, that Hispanics will be targeted as a result of this law.

As I described in my previous blog, the right to equality before the law prohibits discrimination before the law on grounds such as race or ethnicity. Racial profiling, over-policing of particular ethnic groups, and excessive law enforcement techniques disproportionately affecting particular ethnic groups violate human rights law and standards. Furthermore, all detained arrestees are “entitled to trial within a reasonable time or to release” and that it “should not be the general rule that persons awaiting trial shall be detained in custody.”

Ironically, the governor herself could not define what an "illegal" immigrant looks like, but she "assumes" that there are people who can:

  5. What do you expect an open-border illegal alien coddling Mayor and sanctuary city officials to say? I mean really, they want to be reelected just like everyone else. But they run on emotions instead of facts and rule of law.

As far as Jan Brewers comment on not knowing what an illegal alien looks like, I can just imagine what you would have said if she answered "yes". Can you tell me what one looks like?

  7. We have had a taste of what SB1070 means – Sheriff Arpaio has been doing his immigrant sweeps for some time now. Indeed, the very conservative Arizona based Goldwater Institute has a report

Mission Unaccomplished: The Misplaced Priorities of the Maricopa County Sheriff's Office

    The executive summary states:

The Maricopa County Sheriffs Office is responsible for vitally important law-enforcement functions in one of the largest counties in the nation. It defines its core missions as law-enforcement services, support services, and detention.

MCSO falls seriously short of fulfilling its mission in all three areas. Although MCSO is adept at self-promotion and is an unquestionably tough law-enforcement agency, under its watch violent crime rates recently have soared, both in absolute terms and relative to other jurisdictions. It has diverted resources away from basic law-enforcement functions to highly publicized immigration sweeps, which are ineffective in policing illegal immigration and in reducing crime generally, and to extensive trips by MCSO officials to Honduras for purposes that are nebulous at best. Profligate spending on those diversions helped produce a financial crisis in late 2007 that forced MCSO to curtail or reduce important law-enforcement functions.

    Read it all at: http://www.goldwaterinstitute.org/article/2629

The Governor has said that police have taken an oath and will not profile. However, if you complain about the use of profiling by the MCSO, here is what you face:
    http://www.youtube.com/watch?v=7lWMp6KrCfU

Moreover, in March 2009, the United States Department of Justice notified Arpaio of that they were investigating him for civil rights violations, in unfairly targeting Hispanics and Spanish-speaking people. In October 2009, it was reported that the FBI was investigating Arpaio for using his position to settle political vendettas.

Now you know why police officers oppose this kind of legislation.

  21. I happened to be in Arizona on Friday for this auspicious event. Peaceful protests abounded and police were in a very relaxed stateas they observed the onlookers. In large part, this is due to the ambivalence felt by AZ state law enforcement towards this law. It truly puts everyone in a bad situation.

SB1070 does present a great deal of consternation for the ALL residents of AZ and visitors alike. I'm a Texas transplant to Arizona and there is a similiar mindset on some issues. I suspect in a bit of AZ rebellion. AZ is pushing buttons of the federal government to get them to do something about unlawful immigration. It is a very real and very dangerous issue in our desert state. The US is long overdue for an effective human rights oriented law/ policy to be implemented.

One suggestion is to start by reviewing the history of the region and you can gain some useful insight into the micropolitics that really impact thecurrent situation and the presence of human being who have entered unlawfully.

  22. Linda Greenhouse's proposed "I could be illegal" protest buttons recommended for anyone visiting or living in Arizona — can be found on CafePress. Pass it on.

One suggestion is to start by reviewing the history of the region and you can gain some useful insight into the micropolitics that really impact thecurrent situation and the presence of human being who have entered unlawfully.

  24. Funny how all these people talk about insecurity in arizona and blame the illegal immigrants for it, however you are just ignorant because a fence and the national guard can not stop the cartels what makes you think that police will. The only thing police will do is be overworked, distracted and maligned. The real problem is all the drugs the people in your state use. Stop smoking pot, using illegal drugs then you will see a reduction in your crime. The drug users in your state cause your insecurity not the hard working illegal immigrants that this law targets.

  25. Linda Greenhouse’s proposed “I could be illegal” protest buttons recommended for anyone visiting or living in Arizona — can be found on CafePress. Pass it on.

  27. In your own home…any reasonable person would have a visitor come in by invitation or acceptance of said visitor's request. This visitor would probably be encouraged to use the "fruits" of your house. But, if someone came into your house uninvited or without your permission, this same house that you pay for, that you protect your family in, that you have many wonderful memories in…you would probably consider this person an intruder, a trespasser, and you would want them to leave…go back to their own home or maybe, by the rules you set for your home, try to become your real friend and be invited in. The United States is a blessed country, but it cannot continue to sustain a constant and increasing influx of uninvited visitors who want to become more than visitors in our home. I realize it is a complex issue, but there are ways for people to become "legal" visitors and citizens. Sneaking into someone else's home, setting up camp and then demanding the same "everything" that the homeowner has is not the answer. Leaving their own home and bringing their problems with them is not the answer. Their problems then become your problems. You and your family have a reasonable right to live your life, in your home, by the rules you set and not have to be faced with dealing with the problems that an uninvited visitor brings (unless you want to). This bill is in response to frustrated people who are tired of "uninvited" visitors. Acknowledging an even more complex situation, I wonder if the same time, effort and energy trying to make the unlawful lawful was to be put into making these "visitors" own homelands more liveable… Also, the perfect way to not be harassed (all races)…have a legal identification on you at all times and do what it takes to not draw attention to yourself. Granted with some exception, most people of any race will not have issues. If you're not legal, get legal. Lastly, I pray for all people who are trying to find a better life, that they find it, and without incident.

  29. If the media would show the true racists, they would show something like this http://www.youtube.com/watch?v=mDlutO0KK7g A threat of further and future violence? Watch the guy try to get in the middle of the counter protested, then listen carefully to what's said. Also notice how many latino's are counter protesting?

But no, they will only show them (illegal aliens and their supporters) stamping their feet and flailing their arms demanding WE do what THEY want. Waving their babies in the face of reporters. It's just like that little tike that knows he is doing wrong, but time and time again his "progressive" parent lets it slide, then when enough is enough, the hammer falls and that little tike goes on a rampage because its "unfair, and you let me do it before, so why can't I do it now?"

  32. I just want supporters of the bill to understand the seriousness of implementing such a law. I am an educated, legal woman of Puerto Rican descent. Thus, I look "brown." As Amnesty Internat'l has stated, there is no protection against racial profiling within the bill. Supporters of the bill believe the opposition is making unsubstantiated predictions, but what is to stop a law enforcement official from detaining me simply based on the color of my skin? They would have probable cause that I am illegal because of my appearance.

Rather, I think there should be a better proposed solution to curtail illegal immigration, but at the same time, most illegal immigrants who work pay taxes and then do not reap most of the benefits of these taxes (welfare, social security etc.). Furthermore, there is a massive amount of evidence to show that illegal immigrants are the foundation of our economy, and that, especially in border states, the economy would collapse without them. I'm not saying that the exploitation of illegal immigrants is ethical, but these workers are really providing cheap services that our nation relies upon. Please consider these facts before you support this bill.

  33. I just want those who oppose to understand the seriousness that their unfounded accusations and fears are leading to a riot mentality. That same parroting mentality is a cancer and is promising and promoting the collapse or injury of Arizona's economy over something that has not happened yet, and may very well never happen at all… all out of personal reasons I may ad. You people are not fighting for anyone other than your friends and family members at the expense of everyone else. Racial selfishness at it’s best.

Do you not care for the people living here legally? What about those who opt to come the correct, legal, and ethical way? You have no problems hurting those who don't support your unlawful cause, and you know it. It doesn't get much lower than that.

I keep reading these comments that “they are only trying to better their lives”, but wonder how many serious criminals join them on their trek through the desert to “better their own criminal life”? Are we to assume that every illegal alien that crosses the border are all good? None are serious criminals or won’t become such once they slither past the law to get here? What about all these gang members and drug cartels that are within the US? Did they turn to a life of crime AFTER they got here? Or did they come in with you or your family members already as criminals? If there were a way to weed the good from the bad, I sure would like to hear how that could be done without the use of “profiling”, and I’m quite sure the government would also like to know!

Shame on the spin you guys continually spew just to get your own way, regardless of how many are against those ways, and how many lawful people you hurt during your quest.

I see nothing but pure propaganda on these pages parroted by people who have no clue or ignore those clues to no end. Stop using those tired old claims, as they no longer hold water. The money they pay to coyotes could have been used to do it the right way, and in many cases, cheaper. Don’t forget that the added expense of doing it illegally opens the door for your own countrymen to abduct your family member for ransom or rape them along the way. I wonder if those kidnappers were once thought of as “good hardworking people” while they were right alongside you when slithering across our border? Maybe they were some of those good hardworking immigrants who received the 1986 amnesty?

One last thought. I’m sure there will be suits against this excellent law, but knowing it mirrors federal law, and if it gets reversed, what does that do for the federal laws on the books it mirrored? I bet you love that question and can’t wait for the outcome. To be fair, if this law is reversed it would mean that the federal government MUST uphold theirs AND enforce it. Be careful of what you wish for.

  34. How nice indeed, white man, if you could have things ONLY YOUR way !

If you could only have THAT globalization where you SWALLOW the resources of other lands , but SPIT OUT their Peoples like so many seeds ??

If you could only have your Westward RACIAL settler invasion, AND your Southward ECONOMIC invasion, WITHOUT their consequences — the migrations your own movements have ultimately set into motion ?

Your companies are now spraying toxic chemicals over the countryside of Central america. The peoples there run from those deadly clouds to the place where those companies enjoy the good life. THAT is how it comes back to you.

MILITARIZATION is your only solution !!

Your latest "War on Drugs" has MILITARIZED Mexico & murdered 23, 000 lives so far !! It is YOUR war that makes Mexico today a deadly place to live, & the Peoples there are running away from the violence your government has unleashed, coming to the place from where the violence originates. THAT is how it ALWAYS HAPPENS in a war, & that is how it all comes back to you.

And now you propose to militarize ALL OF THE 2000 MILES of the Mexico – US border ? Is that your threat ? Have you gone loco ?

Criminals are coming, you say ? Is that your fear, you who came here as a criminal invasion yourselves ?

In the long lines of brown peoples who wait to be hired so they can harvest your crops for abysmal wages — WORK YOU WILL NEVER DO YOURSELVES — do you only see criminals ??

Because of their low wages, you are able to buy the produce much more cheaply than would otherwise have been the case. And the very Peoples who enable your economy, & take the load of your labor off your backs, & help you keep your cash in your pockets — today you see THEM as the criminals ??

Your miltarization will blowback in your faces, as it is doing now in the Middle East & Afghanistan.

Your criminalization of Peoples who are at your mercy today will EXPLODE in your faces — & no white man's border, no israeli – made wall, will save you from your fall. This time, the harvest will be reaped by you, at its full cost.

  49. Uh…has noone else noticed that a link to the bill is NOWHERE to be found on this website?? Doesnt that strike you odd, that the bill that this website says is pure evil, and hatred and discriminitory and racial isnt on here? I dont get to read it and find out for myself?? Really?? I have to go somewhere else so that I can make an independent judgement on it rather than just believe the words of this website??? Im really really shocked right now. Hold On. Let me read….ok..reading…reading. Holy Crap! The bill actually makes it ILLEGAL to stop people that look like mexicans!!! Apparently…you have to committ a CRIME first! WHAT??? WAIT A SECOND HERE. Let me reread this website again.

"The Arizona House and Senate have passed a bill (SB1070) that would empower police officers to stop and interrogate every individual in the state regarding citizenship status and make it a crime to be an undocumented person in Arizona."

THIS WEBSITE LIED??? WHY?? WHY IS IT LYING?? YOU CANT HAVE PEOPLE RALLY AROUND YOU IF YOUR LYING!!! Whoever is owner of this website, you COMPLETELY have turned me off. I am COMPLETELY for this bill now..as I wasn't before. You gotta be honest you morons. And if you REALLY feel like this BILL IS EVIL…SHOW IT TO THE WORLD! Dont lie about it, and not PROVIDE at least a LINK to it on your website. Idiot.

  50. REALLY OBAMA? Just getting ice cream with my family, and I can be harrassed?? Can you PLEASE explain how that could happen in this bill?? Cause according to the Bill…that would be ILLEGAL! And the person who got Harrassed…again according to this bill…COULD SUE! REALLY? THE PRESIDENT IS LYING NOW?REALLY?

  51. Hey Really, that's what these people here want you to think and believe… what they say that is. My first comment on this particular blog asked for verifiable facts in their claims which has still not been answered.

Have you seen the older closed version of this blog? http://blog.amnestyusa.org/us/tell-arizonas-gover

They started this one after Jan Brewer signed. But they don't seem to be posting much here? I wonder if they started a secret one where they can continue to twist the truth with half-facts and outright fibs so we won't set them straight. I also see no comments about the amendment signed that crushes their unfounded fears of profiling. Interesting.

Maybe they jumped ship to help 60 minutes out on that embarrassing attempt to sway the public this past weekend? http://www.cbsnews.com/video/watch/?id=6453537n It's a must watch for anyone that wants to see how the MSM twists facts to play on the heartstrings of unsuspecting American's. They outright lied several times in that show. The biggest one was where they said the fence built demanded by Duncan Hunter along the border "forced" illegal aliens to move further down where they HAVE to cross that canal. The other biggie was where they left out that an 18ft high fence was built in 2009 along that entire canal. Which was way before this aired, but hey, if they can try to keep that fence out of about every shot, no one will notice it right?

They started this one after Jan Brewer signed. But they don’t seem to be posting much here? I wonder if they started a secret one where they can continue to twist the truth with half-facts and outright fibs so we won’t set them straight. I also see no comments about the amendment signed that crushes their unfounded fears of profiling. Interesting.

Maybe they jumped ship to help 60 minutes out on that embarrassing attempt to sway the public this past weekend? http://www.cbsnews.com/video/watch/?id=6453537n It’s a must watch for anyone that wants to see how the MSM twists facts to play on the heartstrings of unsuspecting American’s. They outright lied several times in that show. The biggest one was where they said the fence built demanded by Duncan Hunter along the border “forced” illegal aliens to move further down where they HAVE to cross that canal. The other biggie was where they left out that an 18ft high fence was built in 2009 along that entire canal. Which was way before this aired, but hey, if they can try to keep that fence out of about every shot, no one will notice it right?

  57. Hey look, the bill…

    Hey look, the FEDERAL LAW!

An explanation of some terms used in the bill written by Kobach, who influenced it:

I really hate to say this to all those people who are saying "They only came here to work and have better lives" Well since 2007 it has been illegal to hire illegal immigrants, regardless of where they are from. As what has also been stated, you have to already have committed a crime for this law to have any effect. People who are fighting for illegal immigrants to have the same rights as a citizen are taking their privileges for granted. People who are opposing this bill are misinformed, having ID of being a legal resident is pretty much universally enforced. When traveling, what happens if you do not have your passport when you travel to other countries? You will get arrested and deported if you cannot obtain proof that you are visiting legally. To bash Arizona for enforcing a federal law and not bash the USA or any other country in the world shows how misinformation leads to horrible propaganda.

  61. Lydia, I visited your link and the moment I read the words "Birthers" and "Nativists" I closed the page without reading anything else. If you want others who have an open mind and read your point of view, may I suggest leaving out the buzzwords that clearly show your lack of understanding and bigotry for those who's opinions differ? I mean really, if you’re attempting to sway someone, insulting them at the get-go is not the way to achieve it.

My interpretation of Comprehensive Immigration Reform is to enforce the laws that have gone neglected for so long. Actually build the fence promised, stop stripping the funding for both the fence and border agents, stop allowing foreign nations to dictate immigration law within the US, and most certainly STOP the catch and release practices this administration is abusing.

Reform yes, lessen and provide amnesty to criminals no. How do you reform a criminal? You certainly don't give in to his wants. You tell him what he did wrong, you punish that incorrect behavior, not reward him. You never reward the few at the expense of the many. That method is a lose/lose for the law and US citizens, and a win/win for? The illegal aliens and their supporters are solely responsible for the wedge they have forced between us. You demand what is unfair as long as it benefits you.

Bottom line: Arizona's law mirrors federal law. The only difference is this law tells the feds to enforce the law and uses STATES RIGHTS to enforce it using their own law enforcement. All you people who are screaming and whining are just upset because a state finally said "Enough of your lawless behavior, we are not going to take it anymore!" You didn’t mind when these same laws were not enforced so you could do as you please. So now you throw these temper tantrums stamping your feet and flailing your arms like children caught in the cookie jar after being scolded for the gadzillinth time. Now the cookie jar has been moved to a secure place and you just can't handle it… “It’s unfair! It’s unconstitutional!” You thought you could get away with it forever, but now that you have been called out on your behavior, you attack. You name-call, accuse those who scolded you, and cry yourselves to sleep. Like the spoiled brats you are, you will do anything including hurting innocent bystanders to get what you want. It’s past time we stopped coddling you!

Go back to your rooms and think about what you did. If and when you apologize and accept the responsibility for your poor behavior we can talk.

Tough love is a good thing.

  63. Hard to argue FACTS isn't it Amnesty Intl? I am sooo sick to death of the mischaracterization of this bill and the FOOLS that buy into it.

Shameful in that the author and editors of this website are LITERATE and can actually read the bill and STILL claim it is racial profiling. Such a shame what Amnesty International has become. There are so many worthy "human right" issues around the world and to waste your time fueling this nonsense and mischaracterization of this bill is shameful.

  65. Except common sense should also tell you that not everyone is benevolent, and Mexicans committing crimes are more likely to be stopped than whites committing equal crimes.

You have to be committing a crime… sure… going 5 miles over the speed limit is technically a crime, but they're not going to use that as an excuse to pull white people over.

  66. So if you are already breaking a law by living in this country illegally…don't speed even 5 miles over the speed limit. Duhhh
