Today begins a monumental week for human rights in Israel and the Palestine National Authority on several fronts.

Over the course of the next few days, in Israel, legislators will begin debate a draft of a law that would put asylum-seekers and migrants at risk for being returned to countries where they would face serious human rights violations. The United Nations will receive the secretary-general’s report on Israeli and Palestinian domestic investigations into violations of International Humanitarian Law (IHL) from December 2008 to January 2009. And in the United States, a congressional letter is circulating asking Representatives to press for immediate relief of the citizens of Gaza.

That’s a lot of activity, and at a time of significant international interest in the region, Amnesty International hopes that it will lead to a renewed focus on human rights issues as the best way to achieve a lasting peace.

To take the various actions of the week one at a time:

* The Israeli Knesset will begin discussion Feb. 3 on the Prevention of Infiltration Law.  The legislation comes out of a current crisis, particularly on the Egyptian border, where refugees from human rights violations – primarily the Sudan and Eritrea – are attempting to reach safety by entering Israel in large numbers. In recent years, large numbers have been forcibly returned to Egypt, where they are at risk of both human rights violations and of being forcibly returned to their country of origin.

Amnesty International is concerned that the draft legislation prescribes lengthy prison sentences for asylum-seekers and irregular migrants and would allow for their immediate deportation, without regard to the risk they might face of torture or other ill-treatment or persecution in the country to which they would be forcibly returned.  We believe the legislation is inconsistent with international human rights treaties and we call about the Knesset to reject the draft law and ensure that any immigration or national security provisions that are introduced into law fully respect Israel’s international human rights obligations.  Click here for more information.

* This past November, the United Nations General Assembly endorsed the findings of the Goldstone Report, which concluded that both Israeli forces and Palestinian armed groups had committed grave violations of international law, including war crimes and possible crimes against humanity, during the three week conflict in Gaza and southern Israel.  Both groups were required to conduct domestic investigations into the allegations and submit reports back to the United Nations in early February.

Amnesty International has called upon both Israel and Hamas to fulfill their obligations in these investigations.  We attempted to ensure both sides conducted their investigations with the required independence, impartiality, transparency and effectiveness. If the reports fail on these accounts, Amnesty expects that the United States and other UN member states will fulfill their responsibility to monitor the investigations.

Feb. 2 update: Amnesty has just issued this release condemning the Israeli response to the Gaza investigations.

* The congressional letter on Gaza, to date signed by 54 members of Congress, expresses sympathy with both the citizens of Gaza and Southern Israel but says the continuing economic pressure on Gaza by Israel has impeded aid groups and economic activity.

The letter calls upon President Obama to press for improvements in the areas of Movement of people, especially students, the ill, aid workers, journalists; access to clean water, medicine, sanitation supplies, construction materials, fuel and spare parts, and passage into and out of Gaza for commercial and agricultural goods. Amnesty International endorses the goals of the letter and encourages members to contact their Representatives to ask that they sign the letter.

Abdallah Abu Rahme is affable and articulate.  Last July, when I called to set up a time to talk before one of the weekly protests in his village, Bi’lin in the occupied West Bank, he made jokes and explained exactly the best way to get there from Jerusalem through all the checkpoints and roadblocks.

Abdallah’s vocation is teaching, but what takes up a good portion of his time is his involvement with the village’s non-violent popular committee which protests the wall/fence built by Israel that snakes through the occupied West Bank (WB).  Israel says the wall is being built for security reasons; others that the wall is simply strangling villages’ economies by cutting them off from their agricultural lands and water sources.

The International Court of Justice ruled in 2004 that the wall is illegal where it sits on Palestinian territory and should be removed.  Eighty percent of the wall is built on Palestinian territory, but five plus years later, most of the wall continues to sit  and be built on Palestinian land.  Popular committees have sprung up across the WB to protest the wall and over the past 18 months, there appears to be an increase in the harassment and prosecution of activists involved in this and other non-violent actions.

Scores of activists, (Israeli, Palestinian and international) involved in peaceful protests have been picked up by Israeli authorities in the past several months.  Many are held at length with no charge being made while still being interrogated, others have been put under administrative detention and others are brought up on charges.

Just to name a few:  Muhammad Srour was detained when crossing the Allenby Bridge from Jordan after testifying before Goldstone’s UN mandated fact finding mission in Geneva.  He stated,

“I know full well that I will pay the price for this testimony when I return at Israeli crossing points in my journey of return after this hearing.”

Mohammad Othman,  known for his vocal support of the growing Boycott, Divestment, Sanctions (BDS) campaign, was held and interrogated for two months before being put under administrative detention.  Dozens of protesters, including drummers, clowns, diplomats and rabbis, have been picked up and released in east Jerusalem, where Palestinians have been evicted from their homes or have had their homes demolished in the Sheik Jarrah neighborhood.  Most recently, Jamal Juma’, vocal and active coordinator of the Stop the Wall campaign, was detained.

Abdallah’s case highlights how ridiculous some of the charges by the Israeli army can be.  On December 10th, exactly one year after receiving the International League for Human Rights’ Carl Von Ossietzky medal Abdallah was arrested – like many others, including children, during a nighttime raid.  An indictment was filed in a West Bank military court yesterday for arms possession, incitement and stone throwing.  The arms possession charge is based on his collection of spent tear gas canisters and cartridges shot at the demonstrators by Israeli forces that he showcases in his home for visitors.

Advocate Gaby Lasky, Abu Rahme’s lawyer said,

“The army shoots at unarmed demonstrators and when they try to show the world the violence used against them by collecting the remnants – they are persecuted and prosecuted.  What’s next?  Charging protesters money for the bullets shot at them?”

The United States is fast losing their credibility in the region and among Human Rights organizations and activists over our reluctance to support the recommendations contained in Justice Richard Goldstone’s report (pdf).

Justice Richard Goldstone, who gained respect internationally for his work in the UN International Criminal Tribunals for the former Yugoslavia and for Rwanda and his human rights work in Argentina, South Africa and Kosovo led an investigation into violations of international law committed by all parties involved in the fighting last winter in Gaza and southern Israel.  The UN mandated investigation found that both Israeli forces and Palestinian armed groups committed grave violations of international law, including war crimes and possibly crimes against humanity, during the conflict.  The report supports Amnesty International’s own findings of war crimes committed by both sides.

Remarks from the State Department and specifically Ambassador to the United Nations, Susan E. Rice do not bode well for the report’s reception in the Human Rights Council and the recommendation that the HR Council take concrete steps to move the process of accountability forward.  Ambassador Rice has said she has ’serious concerns’ about the mission’s mandate and that it is imperative to not get distracted and look forward to resolve the conflict.

Amnesty International believes that justice and accountability can never be an impediment to peace, but are the foundation to an enduring peace in the region.  And that the recommendations contained in the Goldstone report are the best hope for achieving justice for the victims and to end the atmosphere of impunity enjoyed by the perpetrators from both sides and help end the cycle of violence.

Justice Richard Goldstone is scheduled to present the findings of his team’s investigation Tuesday, September 29th to the Human Rights Council.  The HR Council will then discuss the findings and has the ability to refer the report and its recommendations for consideration by the UN Security Council.  The United States recently joined the HR Council and has the ability to sway the council one way or the other.

Send a letter to Secretary of State Hillary Clinton and Ambassador Susan Rice urging them to support the recommendations contained in Justice Richard Goldstone’s report.

Binyamin Netanyahu, Israel’s Prime Minister, has approved the construction of hundreds of new homes in the occupied West Bank and east Jerusalem despite statements by the U.S. government, including many by President Obama, that settlements are an obstacle to peace.

There are approximately 500,000 Israelis living on settlements in the occupied West Bank and east Jerusalem.  All settlements are illegal according to international law and no country, with the exception of Micronesia and Israel itself, view it otherwise.  

Israel does not recognize the West Bank and east J’lem as occupied, but the majority of the international community, including the United States continue to hold both the territories as occupied and should be afforded the protections under the Geneva Conventions and other international bodies of law.

Under international law, an occupying power cannot transfer it’s population into territory it is occupying or change the demography unless it is for the benefit of the population being temporarily occupied. Some say that the Israeli gov’t (GOI) is not transferring it’s population; the population is voluntarily moving there so this argument is mute.  This is disingenuous though as east J’lem and the West Bank are considered occupied territory and the GOI provides infrastructure and military support for the settlements to exist.  Without government subsidies, support and encouragement, the settlements would not exist, nor would the growth continue at such a rate.

Although the current U.S. position supported by President Obama calling for a freeze on settlement expansion including so-called ‘natural growth’ is considered ‘unreasonable’ by some, it actually doesn’t go far enough.

The GOI has been changing the demography and encouraging settlement of east J’lem and the West Bank for over 40 years against international law.  Obama is simply asking Israel to cease illegal activity.  The GOI should not only halt construction, but begin implementing removal of all illegal settlers from occupied territory since all settlements and outposts are illegal, including those in east J’lem and compensate those Palestinians displaced or forced from their homes due to home demolitions or evictions.

We’re happy to bring you some good news in the case of lawyer and human rights activist Shadi Sadr.

We’ve all watched with dismay during that last 2 months as Iran has cracked down on hundreds of thousands of people who have poured into the streets to protest the contested results of June’s presidential election. Behind the scenes, Iranian authorities have conducted a campaign to silence dissident voices — like human rights lawyer Abdolfattah Soltani — through arbitrary arrests and detention.

It was as part of this campaign that Shadi Sadr was detained last month. On July 17, Sadr was walking on a road in Tehran when men in civilian clothes grabbed her and attempted to push her into a car. Sadr lost her headscarf and coat in the ensuing struggle but managed briefly to escape. She was quickly recaptured and beaten with batons, and then taken away in the car.

We are relieved to report that after more than a week in custody, Sadr was released on bail, thanks in part to appeals from Amnesty activists worldwide. Amnesty International is monitoring her situation and will issue further updates as they become available.

Many Iranian Americans have turned to the arts as a means of critiquing the status quo both in Iran and the US. Among them is Maz Jobrani, an Iranian American  comedian and a part of the “Axis of Evil” comedy troupe. He has been touring with the troupe since 2005; his routine surrounding Iran, racial profiling, and being Muslim in America. His act is so popular that he has appeared on shows ranging from the Colbert Report to The Late Late Show with Craig Ferguson.

Last week, Jobrani also voiced his support for upholding human rights in Iran and urged his viewers to attend the Global Day of Action for Iran. “Over the last few weeks, we have watched elements within the Iranian regime react with brutality to people who seek to have a voice in their own government,” he said. “Many have been imprisoned and tortured. Some stand to be executed. We cannot simply stand by.”

Nazanin Boniadi is an Iranian born actress who has appeared on the soap opera General Hospital as well as the films Charlie Wilson’s War and Iron Man. When she’s not on set, Boniadi works alongside Amnesty International as an official spokesperson for disenfranchised populations across the world. She has been increasingly involved with Iranian youth and women, bringing attention to many of their unjust convictions and treatments in detainment. Last year, Boniadi wrote a heartfelt entry on Amnesty’s blog about the Universal Declaration of Human Rights.

Protests in more than 80 countries, with numbers ranging from a couple hundred to several thousand, took to the streets on Saturday to stand in solidarity with the Iranian people against the government’s brutal crackdown this summer. Among the 1,000 people in Amsterdam was Iran’s Nobel Peace laureate Shirin Ebadi who led the crowd in chanting: “We want to live in peace. Long live peace”.

The event will hopefully force the Iranian authorities to display greater transparency regarding election results and provide those imprisoned with their human rights.

“Our message is very simple,” [Aaron Rhodes, an event organizer] said. “We’re supporting civil and human rights in Iran and we’re calling upon the government in Iran to cease their abuse of power, cease the imprisonment of innocent people and the torture of detainees and stop the violence against people who are simply trying to exercise their internationally protected human right to peacefully protest.”

Back in Tehran, opposition leaders Mousavi, Mehdi Karroubi and Khatami urged the country’s clerics to intervene to help stop the spread of “oppression” by the authorities. They accused the government of “savagery” and that its “interrogation methods are a reminder of the dark era of the Shah”, who ruled until 1979.

On July 25, people in more than 60 cities across the world will be standing in solidarity with the Iranian people in their struggle for human rights. Protesters in Iran continue to experience brutality on the city streets while the number of arrests steadily rises– the latest being the detainment of opposition leader Mir Hussein Mousavi’s brother-in-law, Shapour Kazemi.

The global day of action, organized by United4Iran, is organized around the following four core demands:

1. That member states and civil society organizations of the international community give sustained attention to the Iranian people’s human rights as a matter of international concern, and that the UN should immediately initiate an investigation into grave and systematic human rights violations in Iran, including the fate of prisoners and disappeared persons, unlawful killings, and torture and other ill-treatment;
2. An end to state-sponsored violence, accountability for crimes committed and no recourse to the death penalty.
3. The immediate and unconditional release of all prisoners of conscience, including politicians, journalists, students, and civil society activists; and
4. Freedom of assembly, freedom of association, and freedom of expression (including freedom of the press) as guaranteed by the Iranian constitution and Iran’s obligations under international covenants that it has signed.

Amnesty International has just released a report detailing the consistent human rights abuses in Saudi Arabia under the facade of combatting terrorism. Thousands of people have been arrested and detained in virtual secrecy, while others have been killed in uncertain circumstances. Hundreds more people face secret and summary trials and possible execution. Many are reported to have been tortured in order to extract confessions or as punishment after conviction.

Reported methods of torture and other ill-treatment include severe beatings with sticks, punching, and suspension from the ceiling, use of electric shocks and sleep deprivation. Flogging is also imposed as a legal punishment by itself or in addition to imprisonment, and sentences can include thousands of lashes.

Since the attacks of September 11th, Saudi Arabia has been under intense pressure by the West to take on terrorism as 15 of the 19 hijackers were Saudi citizens. Abdulrahman Alhadlaq, a Saudi Interior Ministry official, told The Associated Press that Amnesty International’s assertions were “claims that have to be proven.”
