Israel: Say No to Detention Without Charge or Trial

Khader AdnanAs Palestinian hunger striker Khader Adnan verged dangerously on the border between life and death, much of the world turned its collective gaze toward Israel and the Occupied Palestinian Territory.

Adnan, who was arrested at his home in the occupied West Bank in the middle of the night, had been sustaining a 66 day hunger strike in protest of his treatment by the Israel Security Agency (ISA) and his detention without charge or trial.

Onlookers breathed a collective sigh of relief when Adnan’s lawyer reached an agreement with Israeli authorities on February 21st, prompting the dying man to halt his strike. The state has reportedly agreed not to extend Khader Adnan’s four-month “administrative detention” unless “significant” new evidence emerges, and has said that it will count the days he served in detention before the order was issued on January 10.

He is now due to be released on April 17. However, this is insufficient as Israeli authorities have provided no justification for continuing to hold Adnan.  Instead they need to release him now.

For many, Khader Adnan’s case is emblematic of the systemic violation of Palestinian prisoners’ right to a fair trial, and the Israeli authorities’ compromise has been hailed as testament to the power of peaceful protest. However, the end of Adnan’s suffering is not yet within reach: he remains under constant armed guard and he is still shackled to his hospital bed, despite commitments by the Israeli Prison Service to remove the shackles. He has embarked on a complex recovery process and, as noted by doctors from Physicians for Human Rights-Israel, his life remains in danger.

The hospital staff, who mocked Adnan only days ago, is now expected to care for him during his recovery process.  Khader Adnan’s wife Randa was allowed to visit her husband in the hospital during his hunger strike. She said, “While I was there, he had chest pains and asked a nurse to call Physicians for Human Rights. The nurse yelled at Khader saying that she does not have time for him and that if he needs medical attention he should break his hunger strike. Another doctor mocked him when he asked for water and said that he should also stop drinking water.”

The Israeli authorities allege that Khader Adnan is associated with Islamic Jihad, and cite concerns of his involvement with the military wing known to carry out attacks against civilians. To Amnesty International’s knowledge, however, Adnan has never been convicted of a violent crime.

Adnan’s detention order was originally slated to expire on May 8th, yet there was little guarantee that he actually would have been released.  Administrative detention orders can be (and often are) renewed indefinitely. In fact, among the 300 plus Palestinians who are currently being held under administrative detention, one man has been detained without charge or trial for more than five years. The Israeli authorities use administrative detention to hold prisoners based on “secret evidence,” which they say cannot be revealed for security reasons. As such, detainees and their lawyers are powerless to contest the unarticulated charges or unseen evidence.

Tell Israel to release Khader Adnan and all other Palestinians held in administrative detention!

  1. You did not sufficiently note that the group Islamic Jihad to which Kader admits supporting has proudly admitted responsibility for dozens of suicide bombings aimed at Israeli civilians in which hundreds of innocent men women and children were murdered.

Even if there is no proof he himself has personally engaged in violence, he does admit supporting the goals of an organization that in the past has committed war crimes and crimes against humanity, namely mass murdering women and children in suicide bombings.

And while you may be right that mere support for Islamic Jihad without committing overt acts of violence should not be grounds for administrative detention without trial, it should still give Amnesty and other human rights advocates at least just a little pause before treating a member of a group that advocates murdering innocent women and children as some kind of Gandhi like human rights folk hero.

  3. Judo,

The Israeli government has provided no proof that Khader Adnan belongs to Islamic Jihad and as of a couple of days ago, neither the IDF nor Shin Bet (equivalent of U.S. FBI) would confirm the allegation. There have been numerous cases in the past where proof has not been given for certain allegations, but the allegations have been repeated so often and consistently by certain parties that they are generally accepted as fact. Amnesty is very much committed to the facts – not innuendos – no matter how often repeated.

Too often we have seen governments associate an individual, organization or whole segment of society with an unsavory group simply to smear or justify their actions.

Amnesty International is not hailing Khader Adnan as 'some kind of Ghandhi or like human rights folk hero', but as a human being that deserves his basic human rights.

If Khader Adnan is guilty of an offense, he should be charged and given an opportunity to challenge it in a trial that meets internationally recognized fair trial standards. No one, including Adnan, should be ill-treated in custody and no one, including Khader Adnan, should be punished for a hunger strike undertaken in protest against his ill treatment and detention without charge.

The way Israeli authorities have been using administrative detention over the years – as a wide spread catch all – makes it appear as though it is used not only in cases of immediate and grave threat, but to detain even political activists that are guilty of nothing more than opposing the occupation or the illegal placement of the wall/fence through their lands.

Although not being held under administrative detention, Amnesty recently adopted Bassem Tamimi as a Prisoner of Conscience who we believe was detained solely for non-violently protesting the encroachment of settlements in the occupied territories. 6. Hi Edith

I do understand and even might tend to agree with your point about the Israeli overuse of detention without trial which while it is legal and permitted under the Geneva Convention should be limited to only very rare occasions. I am not arguing with you about that.

I am however saying that you have made a factually incorrect statement in claiming that Adnan is not a well known spokesman for Islamic Jihad and has been for decades, this being a group Amnesty International has categorized as an illegal criminal terrorist organization that has committed Crimes against Humanity including deliberate mass murdering of women and children.

I am mystified why you would want to deny this well known fact that even Adnan family does not deny although they claim he is not involved directly in violence.

Khader Adnan has been repeatedly convicted in open court trials of serving as a leader and spokesman for Islamic Jihad in both Israeli and Palestinian Authority courts and has served time in both Israeli and Palestinian jails for this offence.

The increase in partisanship and political division has eroded general solidarity, even over the once unanimous issue of prisoners. Indeed, even Islamic Jihad, the party of Khader Adnan, has failed to bring its people out in support of the hunger striker. "

Could you please retract your unjustified statement.

The fact that Adnan is a leading figure and spokesman for Islamic Jihad has been publicly acknowledged by independent Palestinian human rights NGOs as well as numerous major media outlets across the Arab and Islamic world.

If you are still have a hard time accepting reality it is because you have unfortunately allowed some of the most evil hate filled monsters on the face of the planet, Islamic Jihad, war criminal mass murderers of women and children, to take advantage of your good intentions. Edith, once more you have been overly gullible and fallen for fake propaganda fairy tales and let the people you support publicly expose you as the poster child example of an innocent uninformed naive western do-gooder being played for patsy. What next? Will you be comparing this guy who supports mass murdering innocent women and children so long as they are Jewish to Martin Luther King Jr. and putting his name up for a Noble Peace prize nomination?

I am very sure starving oneself almost to death took a lot of will power. But then again it also takes tremendous amounts of will power to support murdering women and children. I myself do not have the will power to do either of those acts.

I must therfore be weaker than Khader Adnan.

  17. Judo,

I am not arguing with you. Matter of fact, I am not necessarily disagreeing with you, but you do have a way of reading certain things into statements.

Amnesty International is not denying Khader Adnan may be associated with a group that has carried out violent attacks, but that "to Amnesty International’s knowledge, however, Adnan has never been convicted of a violent crime." I pointed out that despite repeated media reports, the Israeli army and Shin Bet have also not given confirmation.

My comment, “Too often we have seen governments associate an individual, organization or whole segment of society with an unsavoury group simply to smear or justify their actions” stands. It is a fact. And until we see what the specific charges are and what evidence is being used to justify the charge and detention – we don't know anything for sure.

In regards to an earlier comment you made – Amnesty International does not designate any organization as “an illegal criminal terrorist organization” although we do often clarify that some groups are considered ‘a terrorist organization’ by … the United States government, the Israeli government, the Sri Lankan government, the Chinese government, whomever.

As far as actions taken by members of armed Palestinian groups, like Islamic Jihad, we have condemned acts where there is evidence that specific actions have violated international humanitarian and human rights law. For instance, Amnesty International had repeatedly condemned the suicide bombings and other attacks against civilians carried out by Palestinian armed groups during the second intifada, and you’re absolutely correct – we issued an official statement saying, "Palestinian armed groups must put an immediate end to suicide bombings and other attacks against civilians. Such deliberate and systematic targeting of civilians is a crime against humanity." We have also called rockets fired by armed Palestinian groups from the Gaza Strip into southern Israel a war crime due to their indiscriminate nature meaning the person firing the rocket is not able to target the weapon with any accuracy putting civilians at great risk. Israeli civilians have been injured and killed by these rockets and property damaged.

That being said – again – Amnesty is not hailing Khader Adnan as a hero of some kind, but saying that everyone – everyone – has the right to know what he is being charged with and face his accusers and so-called evidence in a court of law that meets international fair trial standards. No one – no one – should be ill treated while detained and no one – no one – should be punished for his/her hunger strike and treated inhumanely – period.

Israel misuses the administrative detention procedure and has detained individuals based solely on their conscientiously held beliefs and not on any specific criminal action. There are currently some 309 administrative detainees in Israeli detention centers – all being held without charge or trial. Children have held and right now twenty something detainees are members of the Palestinian Legislative Council and one gentleman has been held for five (5) years – again – without charge or trial.

  19. Amnesty has in numerous official statements designated the suicide bombings which Islamic Jihad claimed responsibility for as "Crimes Against Humanity", namely the atrocity of the deliberate murdering of unarmed innocent civilians, women and children.

"Crimes Against Humanity" is the harshest condemnation Amnesty can make against any group. "Crimes Against Humanity" is a term which Amnesty reserves for only the very worst or the worst forms human rights abuse and the worst kinds of violations of international law. The Geneva Convention and International Law consider the deliberate murder of civilians, women and children to be the very worst most terrible crime possible in wartime.

Khader Adnan has been widely referred to in the Arabic and Islamic press as "the official spokesman of Islamic Jihad" and "senior leader of Islamic Jihad" and "senior official of Islamic Jihad" and has has held this position since the year 2000.

Here is a partial list of the Crimes Against Humanity, deliberate murdering of civilians, women and children that Palestinian Islamic Jihad has committed just since he became "Senior Official and Spokesman for Islamic Jihad" in the year 2000 .

  20. Amnesty has in numerous official statements designated the suicide bombings which Islamic Jihad claimed responsibility for as “Crimes Against Humanity”, namely the atrocity of the deliberate murdering of unarmed innocent civilians, women and children.

“Crimes Against Humanity” is the harshest condemnation Amnesty can make against any group. “Crimes Against Humanity” is a term which Amnesty reserves for only the very worst or the worst forms human rights abuse and the worst kinds of violations of international law. The Geneva Convention and International Law consider the deliberate murder of civilians, women and children to be the very worst most terrible crime possible in wartime.

Khader Adnan has been widely referred to in the Arabic and Islamic press as “the official spokesman of Islamic Jihad” and “senior leader of Islamic Jihad” and “senior official of Islamic Jihad” and has has held this position since the year 2000.

Here is a partial list of the Crimes Against Humanity, deliberate murdering of civilians, women and children that Palestinian Islamic Jihad has committed just since he became “Senior Official and Spokesman for Islamic Jihad” in the year 2000 .

  21. about the petition for afghan women:
I don't feel to sign it: since 2001 everything made by the Usa in Afghanistan was horrible.
in Afghanistan exist a lot of very strong associations of women, often substained by european women.
I would say: Usa, get off for ever!
how can you beleave in H.Clinton?

p.s. I donate 50 Euros to Amnesty Italy every month, I sign nearly all of the petitions (Italy, UK, Usa).
    kind regards,
