As Palestinian hunger striker Khader Adnan verged dangerously on the border between life and death, much of the world turned its collective gaze toward Israel and the Occupied Palestinian Territory.
Adnan, who was arrested at his home in the occupied West Bank in the middle of the night, had been sustaining a 66 day hunger strike in protest of his treatment by the Israel Security Agency (ISA) and his detention without charge or trial.
Onlookers breathed a collective sigh of relief when Adnan’s lawyer reached an agreement with Israeli authorities on February 21st, prompting the dying man to halt his strike. The state has reportedly agreed not to extend Khader Adnan’s four-month “administrative detention” unless “significant” new evidence emerges, and has said that it will count the days he served in detention before the order was issued on January 10.
He is now due to be released on April 17. However, this is insufficient as Israeli authorities have provided no justification for continuing to hold Adnan. Instead they need to release him now.
For many, Khader Adnan’s case is emblematic of the systemic violation of Palestinian prisoners’ right to a fair trial, and the Israeli authorities’ compromise has been hailed as testament to the power of peaceful protest. However, the end of Adnan’s suffering is not yet within reach: he remains under constant armed guard and he is still shackled to his hospital bed, despite commitments by the Israeli Prison Service to remove the shackles. He has embarked on a complex recovery process and, as noted by doctors from Physicians for Human Rights-Israel, his life remains in danger.
The hospital staff, who mocked Adnan only days ago, is now expected to care for him during his recovery process. Khader Adnan’s wife Randa was allowed to visit her husband in the hospital during his hunger strike. She said, “While I was there, he had chest pains and asked a nurse to call Physicians for Human Rights. The nurse yelled at Khader saying that she does not have time for him and that if he needs medical attention he should break his hunger strike. Another doctor mocked him when he asked for water and said that he should also stop drinking water.”
The Israeli authorities allege that Khader Adnan is associated with Islamic Jihad, and cite concerns of his involvement with the military wing known to carry out attacks against civilians. To Amnesty International’s knowledge, however, Adnan has never been convicted of a violent crime.
Adnan’s detention order was originally slated to expire on May 8th, yet there was little guarantee that he actually would have been released. Administrative detention orders can be (and often are) renewed indefinitely. In fact, among the 300 plus Palestinians who are currently being held under administrative detention, one man has been detained without charge or trial for more than five years. The Israeli authorities use administrative detention to hold prisoners based on “secret evidence,” which they say cannot be revealed for security reasons. As such, detainees and their lawyers are powerless to contest the unarticulated charges or unseen evidence.

I do understand and even might tend to agree with your point about the Israeli overuse of detention without trial which while it is legal and permitted under the Geneva Convention should be limited to only very rare occasions. I am not arguing with you about that.
I am however saying that you have made a factually incorrect statement in claiming that Adnan is not a well known spokesman for Islamic Jihad and has been for decades, this being a group Amnesty International has categorized as an illegal criminal terrorist organization that has committed Crimes against Humanity including deliberate mass murdering of women and children.

The fact that Adnan is a leading figure and spokesman for Islamic Jihad has been publicly acknowledged by independent Palestinian human rights NGOs as well as numerous major media outlets across the Arab and Islamic world.
If you are still have a hard time accepting reality it is because you have unfortunately allowed some of the most evil hate filled monsters on the face of the planet, Islamic Jihad, war criminal mass murderers of women and children, to take advantage of your good intentions. For instance, Amnesty International had repeatedly condemned the suicide bombings and other attacks against civilians carried out by Palestinian armed groups during the second intifada, and you’re absolutely correct – we issued an official statement saying, "Palestinian armed groups must put an immediate end to suicide bombings and other attacks against civilians. Such deliberate and systematic targeting of civilians is a crime against humanity." We have also called rockets fired by armed Palestinian groups from the Gaza Strip into southern Israel a war crime due to their indiscriminate nature meaning the person firing the rocket is not able to target the weapon with any accuracy putting civilians at great risk. Israeli civilians have been injured and killed by these rockets and property damaged.
That being said – again – Amnesty is not hailing Khader Adnan as a hero of some kind, but saying that everyone – everyone – has the right to know what he is being charged with and face his accusers and so-called evidence in a court of law that meets international fair trial standards. No one – no one – should be ill treated while detained and no one – no one – should be punished for his/her hunger strike and treated inhumanely – period.
Israel misuses the administrative detention procedure and has detained individuals based solely on their conscientiously held beliefs and not on any specific criminal action. There are currently some 309 administrative detainees in Israeli detention centers – all being held without charge or trial. Children have held and right now twenty something detainees are members of the Palestinian Legislative Council and one gentleman has been held for five (5) years – again – without charge or trial.

That being said – again – Amnesty is not hailing Khader Adnan as a hero of some kind, but saying that everyone – everyone – has the right to know what he is being charged with and face his accusers and so-called evidence in a court of law that meets international fair trial standards. No one – no one – should be ill treated while detained and no one – no one – should be punished for his/her hunger strike and treated inhumanely – period.
Israel misuses the administrative detention procedure and has detained individuals based solely on their conscientiously held beliefs and not on any specific criminal action. There are currently some 309 administrative detainees in Israeli detention centers – all being held without charge or trial. Children have held and right now twenty something detainees are members of the Palestinian Legislative Council and one gentleman has been held for five (5) years – again – without charge or trial.
Amnesty has in numerous official statements designated the suicide bombings which Islamic Jihad claimed responsibility for as "Crimes Against Humanity", namely the atrocity of the deliberate murdering of unarmed innocent civilians, women and children.
"Crimes Against Humanity" is the harshest condemnation Amnesty can make against any group. "Crimes Against Humanity" is a term which Amnesty reserves for only the very worst or the worst forms human rights abuse and the worst kinds of violations of international law. The Geneva Convention and International Law consider the deliberate murder of civilians, women and children to be the very worst most terrible crime possible in wartime.
