<p>Yesterday, <a href="http://www.washingtonpost.com/wp-dyn/content/article/2009/09/30/AR2009093004840.html ">the EU published</a> its <a href="http://www.ceiig.ch/">final report</a> detailing international law violations that occurred during the Georgia-Russia war in August last year and its aftermath.  This report highlighted many of the original findings detailed in Amnesty International&#8217;s November 2008 <a href="http://www.amnesty.org/en/library/asset/EUR04/005/2008/en/d9908665-ab55-11dd-a4cd-bfa0fdea9647/eur040052008eng.pdf ">report</a> (pdf). The AI report expressed concern for both parties’ use of indiscriminate force against civilians and the use of inappropriate and inaccurate weaponry in largely civilian areas. It also documented extensive looting, arson and violent attacks directed towards Georgian-majority villages in South Ossetia by South Ossetian forces, paramilitary groups and privately armed individuals. The findings of the AI report relied on research gathered from four fact finding missions and the <a href="http://www.amnestyusa.org/science-for-human-rights/georgia/page.do?id=1650025">analysis of satellite imagery</a> provided by AIUSA’s <a href="http://www.amnestyusa.org/science">Science for Human Rights</a> project .</p>
<p>Some of the findings of the new EU Report include:</p>
<ul>
<li>The shelling of Tskhinvali (the South Ossetian capital) by the Georgian armed forces during the night of 7 to 8 August 2008 <a href="http://news.bbc.co.uk/2/hi/europe/8281990.stm ">was not justifiable under international law</a> and marked the beginning of the conflict</li>
<li>Russia <a href="http://www.nytimes.com/2009/10/01/world/europe/01russia.html?_r=1&amp;pagewanted=print">violated international law</a> by recognizing South Ossetia and Abkhazia as independent nations and by distributing international passports within those areas.</li>
<li>Russian forces <a href="http://online.wsj.com/article/SB125431087432152321.html?mod=dist_smartbrief">were guilty of turning a blind eye to ethnic cleansing</a> practiced against ethnic Georgians in South Ossetia both during the war and after the August 2008 conflict ended</li>
<li><a href="http://www.economist.com/world/europe/displaystory.cfm?story_id=14560958 ">Russia’s repeated accusations</a> that Georgia committed genocide were also found to be false</li>
<li>While Russia&#8217;s initial actions in fighting back against attacks in South Ossetia were justified, the level of force used to push back into Georgia &#8220;went far beyond the reasonable limits of defense&#8221; and was <a href="http://news.bbc.co.uk/2/hi/europe/8281990.stm">&#8220;in violation of international law&#8221;</a>.</li>
</ul>
<p>The <a href="http://news.bbc.co.uk/2/hi/europe/8281990.stm">refugee crisis in the region remains</a> since Russia is still refusing to allow ethnic Georgian refugees to return to their homes in South Ossetia  Furthermore, the <a href="http://www.economist.com/world/europe/displaystory.cfm?story_id=14560958">EU report concludes</a> that the risk of renewed violence remains.</p>

<p>Human rights activist <strong>Natalia Estemirova was murdered Wednesday</strong> in the North Caucasus region in Russia. According to <a href="http://news.bbc.co.uk/2/hi/europe/8152351.stm">BBC News</a>, she was allegedly bundled into a van and abducted as she was leaving her home in Chechnya on Wednesday morning. Her body was found shortly after in Ingushetia. <strong>She had been investigating <a href="http://www.amnestyusa.org/human-rights/page.do?id=1031002">human rights</a> abuses in Russia</strong> for some time, working for a human rights organization called Memorial. She focused her efforts particularly on the Chechnya region, where she worked to battle impunity and to gather evidence on an alleged campaign of house-burnings by government-backed militias.</p>
<p>Her murder has occurred just two years after the murder of Russian journalist and human rights activist <a href="http://www.amnestyusa.org/document.php?lang=e&amp;id=ENGUSA20061010001">Anna Politkovskaya</a> in 2007. Human rights activists in Russia continue to be in danger.</p>
<p><a href="http://www.amnestyusa.org/document.php?id=ENGUSA20090715001&amp;lang=e">Amnesty grieves the loss</a> of this courageous woman and prominent human rights defender. Many are left shocked and saddened by the incident. It brings to light Amnesty’s growing concern about human rights abuses in Russia. <p>Amid the global economic crisis, who stole the spotlight?  The Big Three car makers?  The bigwigs and their bonuses? The big banks that caused all the trouble? That&#8217;s where all of the attention has been focused.  But what about the little guys, people whose individual stories we won&#8217;t hear, but who will be living in poverty, due to the global financial crisis. Well, according to the World Bank, there will be 53 million more of them because of the economic collapse.</p>
<p>This kind of massive deprivation for basic needs &#8211; not luxuries like the Palm Beach condos lost in the Madoff scandal &#8211; cannot and will not go unanswered.</p>
<p>Some of the repercussions are already occurring: growing repression, racism and violence.  The <em><a href="http://thereport.amnesty.org/">Amnesty International Report 2009: State of the World&#8217;s Human Rights</a></em>, released today, labels these brewing problems the &#8220;ticking time bomb&#8221; underlying the economic crisis.  In Zimbabwe, hundreds of activists protesting economic decline and social conditions were arrested and detained without charge, with police using excessive force to break up protests. Refugees from Zimbabwe in 2008 faced racism and xenophobia in South Africa that led in one instance to 60 deaths and 600 injuries.</p>
<p>While world leaders are focused on attempts to revive the global economy, they are neglecting deadly conflicts that are spawning massive <a href="http://www.amnestyusa.org/human-rights/page.do?id=1031002">human rights</a> abuses. Amnesty International&#8217;s Secretary General Irene Khan said that, &#8220;Ignoring one crisis to focus on another is a recipe for aggravating both. Economic recovery will be neither sustainable nor equitable if governments fail to tackle human rights abuses that drive and deepen poverty, or armed conflicts that generate new violations.&#8221;</p>
<p>Good point. When John McCain tried to duck the first presidential debate, wasn&#8217;t it Candidate Obama who said, &#8220;Presidents are going to have to deal with more than one thing at a time&#8221;?</p>
<p>So, President Obama. In addition to running GM, appointing a new Supreme Court justice, winding down two wars, gearing up to advance your domestic agenda and closing Guantanamo legally and fairly (come on, you promised &#8220;in concert with our core values&#8221; ), can&#8217;t you do something to help millions of little guys who need food, water, a roof over their heads and a job?</p>
<p>Yep, the United States is expected to exert leadership on every major world crisis. It&#8217;s the responsibility that comes with that label we love: &#8220;world&#8217;s sole superpower.&#8221; And U.S. leadership and respect in the world needs a good makeover. Here&#8217;s the perfect opportunity.</p>
<p>President Obama could ensure that the United States plays a leadership role in uniting world leaders to give sufficient attention not just to &#8220;trickle down&#8221; recovery, but to recovery that helps all people. Recovery that would comprehensively address the problems that lead to and keep people in poverty. That must mean addressing the underlying human rights issues that create and exacerbate human rights violations. His chums in the G20 would be a great place to start.</p>
<p>Come on, Mr. President. Yes You Can!</p>

<p><em>The New York Times </em><a href="http://www.nytimes.com/2009/04/27/world/europe/27hungary.html?hp">reports</a> that institutionalized and societal prejudice against Roma is enflaming violence in Europe:</p>

Over the past year, at least seven Roma have been killed in Hungary, and Roma leaders have counted some 30 Molotov cocktail attacks against Roma homes, often accompanied by sprays of gunfire.</p>

<p>In addition to Mr. Koka’s death, there were the slayings of a Roma man and woman, who were shot after their house was set ablaze last November in Nagycsecs, a town about an hour’s drive from Tiszalok in northeastern Hungary. And in February, a Roma man and his 4-year-old son were gunned down as they tried to escape from their home, which was set on fire in Tatarszentgyorgy, a small town south of Budapest.</p>

<p>Experts on Roma issues describe an ever more aggressive atmosphere toward Roma in Hungary and elsewhere in Central and Eastern Europe, led by extreme right-wing parties, whose leaders are playing on old stereotypes of Roma as petty criminals and drains on social welfare systems at a time of rising economic and political turmoil. As unemployment rises, officials and Roma experts fear the attacks will only intensify.</p>

<p>Persecution against Roma, as <a href="http://www.amnestyusa.org/document.php?id=ENGNAU2009050110456&amp;lang=e">detailed</a> in just one <em>Amnesty International </em>press release from yesterday, is nothing new. Neither is the unwillingness of authorities to stop the oppression. In the Czech republic, for instance:</p>

<p>Roma&#8230; continue to suffer discrimination at the hands of both public officials and private individuals, including in the areas of housing, education, health care and employment.</p>
<p>Not only do they face forced evictions, segregation in education and racially motivated violence, but they have been denied justice when seeking redress for the abuses against them.</p>

<p>The history of Roma persecution goes back hundreds of years ago. Throughout 16-18th century, Roma were hanged without trial in Europe. In 1921, nonetheless, Czechoslovakia shortly recognized Roma as “nationality.” In 1933, Hitler ordered sterilization of Roma. Later, up to half a million Roma were killed in the Holocaust. In just one act, 4,000 Roma were gassed and cremated in Auschwitz on August 2, 1944. Unlike the Jewish victims, Roma victims of the Holocaust are rarely researched or commemorated.</p>
<p>With some activism in Eastern Europe in the 1990s, Roma still face institutional and social discrimination in Europe. In Italy, the government fingerprints them. In 2008, <a href="http://www.dailymail.co.uk/news/worldnews/article-1038747/The-world-shocked-Italian-sunbathers-ignoring-dead-gipsy-girls--But-Italy-showing-chilling-Roma-children.html">bodies of two drowned Roma children were left at the beach</a> while Italians and tourists vacationed a few feet away.</p>
<p>As late as 1998, the state of New Jersey in the US had anti-Roma laws. Popular American TV star <a href="http://blogian.hayastan.com/2007/11/13/racism-in-the-us-from-judge-judy-to-everyone-lese/">Judge Judy has used the word “Gypsy” at least once as a synonym for a “thief” on her show after 2005.</a> While Judge Judy&#8217;s remark can be explained perhaps by her lack of knowledge of Roma issues, the same cannot be said about influential people in countries with large Roma populations. In one such state, Romania, the president called a journalist <a href="http://news.bbc.co.uk/1/hi/world/europe/6989708.stm">&#8220;dirty Gypsy&#8221;</a> in 2007.</p>
<p>While many Roma have historically assimilated (accepted, for example, Islam in the Middle East and Christianity in Europe), scores of them choose to keep their ancestral, migratory way of life despite hundreds of years of slavery, universal persecution and genocide. Others have established enclaves in different countries where they demand integration and respect. Roma supposedly left India as a result of foreign invasion to avoid persecution. Their common name &#8220;Gypsy&#8221; is a misconception that Roma originated in Egypt.</p>
<p>Many of the unassimilated Roma demand freedom of travel and not be regulated.<br />
A unique case of stateless people, Roma do not demand independence or even political autonomy. The Roma persecution has brought about little outrage throughout the world. The problem, in this case, is definitely the lack of awareness.</p>
<p>In my home country Armenia, for instance, the word &#8220;Bosha&#8221; is an insult &#8211; while it used to be the ethnic name for the Roma who have either entirely assimilated or prefer to be called Lom. Their language, Lomavren, a unique mixture with medieval Armenian, has long vanished.</p>
<p>It is time that the world stand up against <a href="http://en.wikipedia.org/wiki/Antiziganism">Antiziganism</a>. Perhaps <em>Amnesty International </em>should adopt the cause of fighting Antiziganism as one of its main goals?</p>

In addition to <a href="http://blog.amnestyusa.org/iar/organizers-of-moldovas-twitter-revolution-remain-at-risk/">organizers of peaceful protests</a>, several civil society organizations, including Amnesty <a href="http://www.amnestyusa.org/document.php?id=ENGUSA20090429002&amp;lang=e ">International</a>, are now being targeted in an <a href="http://www.rferl.org/content/Moldovan_NGOs_Complain_Of_Official_Harassment/1618143.html ">intimidation campaign</a> from the government.</p>
<p>These organizations have received letters from the Ministry of Justice, dated April 16, asking each to explain its position on the riots and any measures taken by them to prevent and stop the violence. Some of the organizations are claiming that this is a <a href="http://www.rferl.org/content/Moldovan_NGOs_Complain_Of_Official_Harassment/1618143.html">&#8220;call to statements of loyalty&#8221;</a>. The majority of these organizations have also received subpoenas from their local tax inspectorates asking them to submit financial reports for 2008 and 2009, and identify their sources of income and expenditure.  Furthermore, on April 28, representatives from the local tax inspectorate visited the Amnesty International office in Moldova, requesting that the organization provide all consultants&#8217; contracts for 2008 and 2009 as well as a copy of the list of paid members and all their passport details. This creates a grave concern for the protection of human rights and human rights defenders in Moldova, which should be guaranteed under the <a href="http://www2.ohchr.org/english/issues/defenders/docs/declaration/declaration.pdf ">UN Declaration on Human Rights Defenders</a>.</p>
<p>Nicola Duckworth, AI’s Europe and Central Asia program director, made the following statement:</p>

<p><em>Reporters Without Borders</em> has <a href="http://www.rsf.org/print.php3?id_article=30800">hailed the release</a>:</p>

We share the joy of Zahidov’s family, lawyers and support committee, who had been awaiting his release since last month, and we urge the authorities to free the three other journalists still in prison. <p>On April 6, protestors participated in a “peaceful day of mourning” in Chisinau, in order to demonstrate against the outcome of the recent parliamentary elections. The next day, in a separate event, the protests turned into violent riots as the crowds attempted to overtake government buildings. It is unclear who started the violence, with witness accounts stating that objects were being thrown at police forces from the crowd as well as allegations that plain clothes police officers in the crowd provoked the violence.</p>
<p>The organizers of the April 6 demonstration, including fellow blogger <a href="http://natmorar.livejournal.com/">Natalia Morar</a>, used <a href="http://www.rferl.org/content/Moldovas_Twitter_Activist_Under_House_Arrest/1610122.html">twitter and social networking sites </a>to mobilize people. The government has accused these organizers of the peaceful protests of also planning the violence on April 7, even though they did not organize these riots. Two of the organizers, including Natalia Morar, are hiding, and <a href="http://www.amnestyusa.org/actioncenter/actions/uaa09609.pdf">urgent action</a> is needed to protect them. <a href="http://www.economist.com/PrinterFriendly.cfm?story_id=13497056">The Economist</a> just published a story that sums up Moldova’s chaos pretty well.</p>
<p>The protestors were demonstrating against the recent elections, which the opposition claims were manipulated. Faced with these accusations, President Voronin agreed to a recount, which the Constitutional Court authorized. This recount is being boycotted by the opposition, as they claim that it is a <a href="http://news.bbc.co.uk/2/hi/europe/7999666.stm">“trick”</a> by the ruling party to distract from the fraudulent activities.</p>
<p>Moldova is a young democracy, gaining its independence after the fall of the Soviet Union. The move to a democracy has not always been easy for the Post-Soviet States, and even within Moldova there is a disputed autonomous region. The recent election has demonstrated some of the <a href="http://www.nytimes.com/2009/04/15/world/europe/15moldova.html?_r=1&amp;ref=Europe">divisions within the country</a>, as the current government has close ties to Russia and many of the opposition wants to move closer to their Romanian and its Western neighbors. Despite the difficulties in of being a young democracy, human rights cannot be ignored. Not only must the government be held accountable for any human rights abuses already committed, but it must reaffirm its dedication to human rights, ensuring that they will be respected no matter the outcome of the recount. This recount should be transparent and fair.</p>

In 2002, <a href="http://edition.cnn.com/2002/WORLD/europe/04/18/spain.kissinger/index.html">Judge Garzon also sought unsuccessfully to question Henry Kissinger</a> concerning alleged U.S. complicity in acts of state sponsored assassination carried out by Latin American dictatorships in the 1970s and 1980s.</p>
<p>The Spanish complaint names six senior lawyers from the Bush administration: former Attorney-General <strong>Alberto Gonzales</strong>, <strong>David Addington</strong>, <strong>William Haynes</strong>, <strong>John Yoo</strong>, <strong>Jay Bybee</strong> and <strong>Douglas Feith</strong>, the former under secretary of defense for policy. <a href="http://online.wsj.com/article/0,,SB108536328513619251,00.html?mod=opinion#printMode">Feith went on record</a> in a Wall Street Journal op-ed piece in May 2004 in support of observing the Geneva Conventions in the context of the War on Terror and his inclusion on the list raises some intriguing questions.</p>
<p>The Spanish action comes at the same time as the British Attorney General, Baroness Scotland, has directed London’s Metropolitan Police Service to investigate the participation of a Security Service (MI5) officer known only as Witness B in the interrogation of <a href="http://news.bbc.co.uk/2/hi/uk_news/7965968.stm">former Guantanamo inmate Binyam Mohamed</a> during his detention in Karachi in 2002.</p>
<p>Yet calls inside the United States for Bush administration officials to be held accountable for the abusive policies adopted as part of the global <a href="http://www.amnestyusa.org/war-on-terror/page.do?id=1011329">war on terror</a> continue to fall on deaf ears in Washington. Although Judge Baltasar’s investigation is unlikely to lead to those named in the complaint appearing in a Spanish courtroom any time soon, it is nonetheless a timely reminder that <strong>crimes were committed and that those responsible have walked away from the mess they created scot free</strong>.</p>
<p>In the next few weeks Americans will have the opportunity to reverse this situation without looking to a foreign court to take the lead. The Senate Armed Services Committee is soon expected to re-release its damning bipartisan December 2008 report on the <a href="http://levin.senate.gov/newsroom/supporting/2008/Detainees.121108.pdf">Treatment of Detainees in U.S. Custody</a> reinforced by more than 200 pages of newly declassified material not previously released to the public.</p>
<p>The first version of this report identified those senior officials most responsible for the detainee abuses that occurred in Iraq, Afghanistan and Guantanamo. This expanded version will lay out the evidence of their complicity in compelling detail. The Committee Chairman, Senator Carl Levin (Democrat, Michigan), has already stated that he plans to refer the report to the Department of Justice. The Obama administration will then face the first great test of its campaign rhetoric. The President has said that no one in America is above the law, he will soon have the opportunity to prove it.</p>
