War Crimes in Sri Lanka: Time for UN to Act

Delivering the petition to the UN

Last May, Amnesty International launched a global action calling on the UN to establish an international investigation into war crimes and other abuses committed during the war in Sri Lanka.

Both the Sri Lankan government and the opposition Tamil Tigers were responsible for massive human rights abuses and violations of the laws of war during the 26-year conflict.

In response to Amnesty’s call for action, over 52,000 people signed our petition to UN Secretary-General Ban Ki-moon demanding an international investigation as a first step toward accountability for these crimes.

This past Tuesday, Feb. 22, I had the privilege of accompanying Yolanda Foster, the Amnesty researcher on Sri Lanka, and Dr. Kasipillai Manoharan, the father of one of the “Trinco 5” students killed by the security forces in 2006, to the UN offices in New York as we delivered the signed petitions to the UN.  We pressed the UN to act on our petition without delay and let them know we would be following up to make sure an international investigation is promptly established.

The U.S. government has not yet joined Amnesty in our call for an international investigation.  We could use their support.  Please write to Secretary of State Hillary Clinton and ask that the U.S.  government encourage the establishment by the UN of an international investigation into war crimes and other abuses in Sri Lanka.  For Dr. Manoharan’s sake and that of all the other families of the victims, we cannot stop campaigning until they receive justice.

    146,679 Vanni people missing within a year of war: Bishop of Mannaar

    According to records of the Sri Lanka Government Agent offices of Mullaiththeevu and Ki’linochchi districts, the population of Vanni was 429,059 in October 2008.

    The total number of people who got into Sri Lanka government control after the war was 282,380, according to UN update as of 10 July 2009.

    “Due clarification should be made regarding what happened to 146,679 people, which is the discrepancy between the number of people who came to government controlled areas between October 2008 – May 2009 and the population reported to be in Vanni in early October 2008,” said the Catholic Bishop of Mannaar, Rt. Rev. Dr. Rayappu Joseph in his submission to the LLRC

    The Bishop has also raised the issues of militarization, colonisation, land grab, Sihalicization, Buddhicisation and civil as well as human rights abuses that take place in the Tamil land following the Tamil war.

    Australian Tamils held a protest rally in front of the Parliament House, Canberra, Thursday urging the Australian Government to reject the nomination of retired Sri Lankan Navy Commander Admiral Thisara S.G. Samarasinghe as the new High Commissioner to Australia. The rally was jointly organised by two of the member organisations of Australasian Federation of Tamil Associations (AFTA), the Eelam Thamizh Association of Sydney and the Canberra Tamil Association. The protesters also demanded independent international investigations into war crimes committed in Sri Lanka during the last phases of war, and particularly the crimes of Dr Palitha Kohona, an Australian citizen and a current Sri Lanka diplomat at the UN.

    Sri Lanka uses the same logic for the innocent Tamils who are fleeing for their lives in boats and ships to foreign shores. They blame the fleeing children and pregnant women as terrorists. Only crime they had committed was that they cried when their fathers and brothers were brutally murdered and they objected when their mothers and sisters were raped.
    What make things worse in Sri Lanka are not just the atrocities carried out by the fascist forces but the compromise made by some international elements, who have decided to support the criminals but turned a blind eye to the victims. They danced when the war criminals sang, and hid their faces in the sand when thousands of innocents were murdered in cold blood. UN, who is supposed to be a guardian for the oppressed and vulnerable in the world, had in fact assisted Sri Lanka in mass murdering innocent Tamils, simply by ignoring the cries of the dying at the crucial hours.

    Sri Lankan Tragedy is also about an "unfair world" that is letting the murderers and rapists to walk on red carpets but ignoring the plight of the innocents that are languishing in torture camps and prisons.

UN kept its silence and still keeping its silence. But when North Korea tested one bomb underground, immediate meeting held. WHY???

No sanctions yet for Sri Lanka despite thousands slaughtered under Rajapkse's regime. Wake up America and take responsiblity and be fair. Did A I or UN investigate the atrocities by the US and British military in Iraq and Afghanistan on innocent civilians? Did they investigate the slaughtering in Chechniya and Pakistan?   62. The call for war crimes committed in Sri Lanka is against both parties responsible for the killings in that country, one the state criminals responsible and the other the LTTE criminals. Given that the state actors carry a higher culpability it will be matter for an independent UN Tribunal to adjudicate based on the facts of the case.Because of the inexplicable delays by the UN certain private parties have already taken the very bold and commendable private initiative to seek justice through the Courts system worldwide, whether it be the before the ICC, European Court of Justice or the US Courts.

These civilians were taken against their will and they escaped as soon as the Security Forces broke through. We have seen their escape on television screens. The allegation of thousands of civilian deaths cannot be substantiated. You just need to do the math.

    Now turning our attention to allegations of violations of international humanitarian law in the process of defeating this terrorist organization which so deliberately and callously used the thousands of civilians as a human shield and as a bargaining chip, and ignored calls by many, including the Secretary-General of the UN, to let these civilians go. So far, these allegations remain in the realm of simple allegations. It is interesting that the rump LTTE, its well-wishers, and the Tamil Net have been working overtime propagating these stories, many of which are fanciful, and far removed from fact but which have been sadly picked up by liberal thinkers in the West.

    Organizations such as Amnesty International, Human Rights Watch, and the International Crisis Group have all picked up these stories. The State Department report refers to these allegations but takes care to characterize them as "allegations". It was Goebbels who said that even a lie, repeated often enough, will gain credence as the truth.

As a sovereign state, Sri Lanka had the responsibility, in the first instance, to protect the vast majority of the population from terrorism and, also, to investigate allegations of infractions of global standards, that can be substantiated, to investigate them. The primary responsibility is for the state itself to deal with any infractions. The allegations must not only be made for the benefit of international entities and global headlines or simply be fanciful, but also be brought to the attention of the national authorities. A proper procedure must be observed. Sri Lanka has a mature legal system and any violations of domestic law can be handled by the Courts. A petition for Habeas Corpus or a writ application is available to an aggrieved entity. Those who made these allegations have not taken the trouble to invoke the domestic judicial processes or the Courts. It is also interesting that those who make these allegations have not thought it fit to invoke the Fundamental Rights provisions of the Constitution, which have been invoked in other instances by many people. Torture is a serious crime in Sri Lanka and the legislation incorporates international standards.

    Sri Lanka, for its part, has also established a Lessons Learnt and Reconciliation Commission to examine all aspects of the conflict, which could include allegations of violations of IHL. This Commission has borrowed extensively from the South African and British experience. The emphasis is on restorative justice. The State has taken upon itself the responsibility of compensating the victims. Anyone with evidence of any violations has been invited to come before the Commission. Hundreds of people have done so. The AG’s Department has a special unit in place to investigate any matters referred to it.

    When the LLRC invited Amnesty International, Human Rights Watch and the ICG to present any evidence in their possession to the Commission, they jointly decided not to do so. This makes their claims and allegations more than a little suspect.

    In summary, where there are local remedies to deal with violations that can be proved, the enthusiasm to simply clamour for international interventions is simply disingenuous and not consistent with international law and practice. This is simply an attempt to draw international attention, score propaganda points, rather than an effort to remedy a wrong.

    Instead of continuing to smear the good name of the Government of Sri Lanka internationally, while forgetting the criminal reign of the LTTE which lasted over 27 years, it may be of help, if the critics and the aggrieved resorted to the remedies so readily available under the domestic legal system.

    It is important for us to remember that there is no such enthusiasm among the people of Sri Lanka to continue to delve into these allegations. The yearning is for peace and to move forward. All the communities of the island join in this one aspiration.

    It would be far better to permit Sri Lanka go get on with the task of healing and reconciling rather than continuing to scratch a wound that is so desperately trying to heal.

  74. The call for war crimes committed in Sri Lanka is against both parties responsible for the killings in that country, one the state criminals responsible and the other the LTTE criminals. Given that the state actors carry a higher culpability it will be matter for an independent UN Tribunal to adjudicate based on the facts of the case.Because of the inexplicable delays by the UN certain private parties have already taken the very bold and commendable private initiative to seek justice through the Courts system worldwide, whether it be the before the ICC, European Court of Justice or the US Courts.

    Meanwhile the desperate Sri Lanka government is trying its usual stunt of stymying justice through a silly “KP initiative”, an arms smuggler, now cosy with the suspect war criminals in the country.

    Even an independent World Peace Citizens Tribunal , including a retired Supreme Court Judge from India, had deliberated on the massive war crimes committed towards the end of the war and found 52 top war criminals guilty of heinous crime against humanity. Although the Sri Lankan government was notified through its Embassy in London it shunned that Tribunal in toto. It’s happening now with the UN efforts! A real shame.

    Let the truth be found out and let universal justice prevail.

    This `unbiased` negotiator, who appears to actually be on the payroll of the Sri Lankan government, though indirectly, something that is obviously known to the United Nations. Vijay Nambiar`s brother (Satish Nambiar) is a paid consultant for the Sri Lankan army, and has been since 2002. Is there any link between the UN and the Sri Lankan army`s paid consultant?

  86. For more than sixty five years, successive Sri Lankan governments backed by racist Sinhala extremists have been oppressing the Tamil minorities. They brutally killed thousands of innocent Tamils, burnt their properties and sent the rest in ships as refugees to the North of the country in the fifties, sixties, seventies and eighties.
    When Tamils asked for their rights, Sinhala extremists always responded with violence.

    As long as the government is successful in covering up the atrocities and mass graves, they can pretend to be happy. But, you can read their faces, they are worried that the truth might come out one day and they may be held responsible for the massacres. Tamils are sad that their sacrifices have gone in vain because the whole world was naive to believe the government and watched in silence the carnage and burial of 50,000 which are still unaccounted for.

    1969 – Tamils seek redress through the judiciary and the Privy Council in London directs the Supreme Court in Sri Lanka to review the constitutionality of the Official Language Act, since it violated s.29(2) the constitution.
    1971 – The government responds by abolishing appeals to Privy Council. Another non-violent path is closed by the Sinhalese government.

    1972 new Sinhala constitution imposed on Tamils
    1972- The new Republican Constitution was adopted and imposed on the Tamil people without their consent.
    The only legal safeguard provided by the entrenched section 29(2) of the Soulbury constitution, described by the Privy Council in London that they "represent the solemn balance of rights between the citizens of Ceylon, the fundamental condition on which inter se they accepted the constitution; and these are therefore unalterable under the constitution", was scrapped.
    Tamil parties walked out of the constituent assembly. With this, Tamil participation of the democratic process in Ceylon (Sri Lanka) came to an end.

    In mid-December 2008, we said to Irene ‘We recognise the considerable and impressive changes you have achieved, and the strong, decisive leadership you provide. Nonetheless, we believe that it is in the overall interests of AI that no one leader – how ever good they are – stays in office for too long, and that two terms is an appropriate time for any one person to lead AI.’

    Irene Khan did not agree with this IEC decision and argued strongly to the IEC that we had reached the wrong conclusion.

    In December 2008, we were, therefore, faced with three options:

    (a) To change our decision in the light of new information or arguments. Although we listened carefully to Irene’s reasoning, we decided that this would not be right for AI.

    (b) To dismiss Irene Khan from the post of Secretary General. Under UK employment law any employee who has been in post for a long period (Irene Khan had been in post for seven years by early 2009) has substantial employment rights. In practice, this means that even though an employee is on a ‘fixed term contract’, he or she cannot simply be told to leave at the end of the contract without compensation. The only way to end a period of employment after such a length of time is to issue a dismissal notice (or to make the post redundant, which was never an option because AI must have a Secretary General).

    (c) To reach a confidential agreement with Irene Khan in which we would agree with her that she would leave at the end of 2009 and in which we would pay compensation for loss of employment and in respect of any employment rights under UK law that might not have been observed.

    Following extensive discussions within the IEC, after taking considerable expert advice from lawyers, and after detailed discussions with board members who had dealt with similar situations in other organisations, the IEC chose option (c).

    We did this with great reluctance but we believed that option (b), the formal dismissal of Irene Khan, would have done enormous damage to the operations and reputation of AI, and could (in our judgement) have led to substantial legal arguments and financial risks. It could also have damaged the reputation of Irene Khan. It would have made it very difficult indeed for the International Secretariat to function effectively, and it would therefore have had a major adverse effect on the overall work of AI for human rights.

They brutally killed thousands of innocent Tamils, burnt their properties and sent the rest in ships as refugees to the North of the country in the fifties, sixties, seventies and eighties.
    When Tamils asked for their rights, Sinhala extremists always responded with violence.

    As long as the government is successful in covering up the atrocities and mass graves, they can pretend to be happy.
