Sri Lanka: judicial independence threatened

The Sri Lankan Foreign Minister reportedly told Parliament yesterday that the government would address within the Sri Lankan legal system any alleged violations of international humanitarian and human rights law during the recent fighting between the military and the opposition Tamil Tigers.  Thus, there would be no need for an international investigation.  The Foreign Minister pointed to a long, well-established tradition within Sri Lanka of an independent judiciary.

Before anyone gets too sanguine about the prospects of an effective investigation being carried out by the Sri Lankan government of the human rights abuses and war crimes committed by both sides during the recent fighting, I’d suggest that you first look at the report on Sri Lanka recently issued by the International Bar Association’s Human Rights Institute.   The report has very disturbing findings about the vulnerability of the Sri Lankan judiciary and legal profession to political interference.  It underlines the need for an international investigation if we’re ever to get the truth about what happened during the last stages of the war in Sri Lanka.

  1. What's the difference between Sri Lankan law and International law ?? Being a former colony, Sri Lankan Law is quite similar to that of England and actually was made by the British. Would you challenge the English courts too ??

    From what I see, you guys are too desperate to know as to what's happening in Sri Lanka and trying to find some excuse to poke your fingers in to their internal affairs. What difference can an International investigation make apart from trying to make a mountain out of a mole hill, blowing things out of proportion and giving media some thing to utter about ??

    I think it is high time you leave internal affairs to be handled internally and not Internationally.

  2. In response to Danny Crane's comments, how a country treats its citizens is not an "internal affair." It's properly a matter for international concern. There's plenty of international law on this subject, if you're interested. For example, Sri Lanka is a party to the International Covenant on Civil and Political Rights, as well as its Optional Protocol, so Sri Lanka has agreed that an international body, the Human Rights Committee which oversees compliance with the Covenant, can receive complaints from Sri Lankan citizens alleging violations of their rights under the Covenant.

No violation of a human or natural Right in another land is an "internal matter", just as such a violation in one's own land is never just a matter "for the police" or a "private family" business. It becomes a matter for us all, tho' only they respond who feel that violation in their own bones.

    Where such people draw the line is by acting as a moral force with other individuals like themselves, they don't talk like Mia Farrow discussing Darfur ( where there's no genocide by the state going on ) with Eric Prince of the Blackwater mercenary army. THIS moves towards a possible violation of a country's internal sovereignty.

I am sure that they are a part of this ""International Covenant on Civil and Political Rights""…

    It is this double standards of yours that has messed the whole bowl of Soup my Friend !! It is not about SL allowing you to come to the beautiful island, it is protesting to the double standards that you practice. If it is Law – it should be equal to any party.

    You file a case of HR violations in Gaza, Iraq & Afghanistan tomorrow, the following day, you will be provided with access to SL I bet… !

    At this moment of me typing this mail, there are 3 Tamil co-workers around me. Do I or anybody from the GOSL try to kill them ?? Will the president himself allow his niece to get married to a Tamil if he hates Tamils ? You lairs should know that 53% of the Tamil population in Sri Lanka are living in other parts of the country and not in the north. Do you hear them complaining about them being harressed or Killed for nothing ??

  11. In response to Danny Crane, I'd suggest reviewing the AIUSA website for the country pages on Israel and the U.S., or looking at the AI annual report for 2009 (also available on the website). You'll see that AI has been active in campaigning against human rights violations in those countries. The charge of a double standard is unfounded.
