Security and Human Rights in the Kashmir Valley

Violence has escalated in the Kashmir Valley yet again, leaving 9 people dead, including at least one woman.  This comes after violence a couple of weeks ago left 14 dead.  The valley has been under a curfew, but anger has boiled over against Indian security forces and government institutions.  The Chief Minister of Jammu and Kashmir, Omar Abdullah, has called for calm.  That’s a good idea, but I’m more than a little concerned at the ham-handed way the Kashmiri police, the state government and the central government are dealing with the protests.

It’s certainly understandable for the government to want to prevent damage to government buildings, but shooting people who are protesting is not only a violation of human rights standards, but it also pisses people off and makes them even less inclined to see India as anything but a foreign occupier who does not care about the security and human rights of Kashmiris.  Given Kashmir’s history within India since 1947, you would think that the Government of India will do everything it can to prevent civilian deaths, but it seems that they can never learn their lesson.

  1. 58 inocents & unarmed Kashmiris have been killed by indian firces from last three months , and Amnesty is doing nothing rather than issuing these posts , we want Amnesty & UN to intervene practically , you guys r failing to pressurize indian government & its really sad , no one is coming out for our help….

  3. How many police and security personnel were injured? Were these peaceful protesters or were they violent people who were warned repeatedly? Were the shootings wanton or were they done under extreme stress when small groups of police were forced to fend off large angry mobs that threatened to cause serious injury by throwing rocks? Are the anti-Indian mobs mindful of the human rights of the security forces, and do they worry about injuring security personnel?

It might be that the government is not releasing the numbers, because I am surprised by this.     1. Bring out a full Report on Kashmir.

    2. Mobilize letter & petition campaigns to the indian government on specific issues like

    a. political prisoners.

    b. incidents of abuse, rape, & staged "encounters" committed by indian forces.

    b. calling for a halt to the repression, the curfews, & the mass shootings as THE responses by the indian forces towards the popular mass demonstrations & student agitations.

    c. urging the removal of the draconian laws mentioned above.

    d. organizing seminars highlighting the dreams & demands of the Kashmiri people.

    These would start the process of informing & mobilizing world opinion about this rapidly & hugely escalating crisis that can spark a regional war.

  23. Dear Govind Acharya : Yes it is true that we (Kashmiris) are pelting stones on the Indian forces. But you have to know the cause why we are pelt stones on them.

    We are protesting "peacefully" for right to self-determination which was promised to the Kashmiri nation by India in 1947. UN stands witness to it. Almost 38 resolutions have been passed by the UN from time to time for providing justice to the nation of Kashmir. So whenever we lead peaceful demonstrations for our basic rights promised by the India, the Indian forces shower live bullets on us.

    In last two months Indian forces killed 51 innocent Kashmiris who are between 7 to 25 years of age.

    We have been put under house arrest since 22-Jun-2010 till date, and now almost we have nothing to eat. Infant food is almost out of stock and they are starving.

    Indian media is completely “silent”, people of India/world are not aware of what is happening in Kashmir!
    I urge HR to intervene and pressurize India to stop immediately killing innocent Kashmiris and remove the months old curfew imposed in different towns and cities of Kashmir valley. We also request Red Cross to send some medicines to Kashmir.

Kashmir is a very hard issue to campaign on in the United States because of India's general reputation in the country (however well deserved or not). Nonetheless, I'll keep working on the issue and keep highlighting it any chance I get. I encourage all of you to continue keeping the pressure on AI and me to keep working on the issue as well!

    First, the violence in Kashmir is typical of violence across the entire subcontinent wherever official force is sanctioned. Encounter killings, police torture, abuse of tribals, certain castes, religious minorities and other unempowered peoples is rife everywhere from Kashmir to Kanyakumari, from Balochistan to Chittagong. Kashmir is special only in the sheer numbers of military forces present there. So it is necessary to critically examine the claims of exceptional political force by Indian army. This is not to justify any use of excessive force. It should reduce — everywhere in India.

    Second, Kashmiris should think about their demand for freedom more carefully. Neither India nor Pakistan is actually interested in an independent Kashmir. The people of Kashmir may imagine they want it but they are a land-locked region with strategic resources that neither India nor Pakistan can afford to lose control over. There is no path towards freedom that is practical. An independent Kashmir would be entirely at the mercy of both India and Pakistan. Kashmiris protest in India because they are able to do so. On the other hand they seem to have ceded PoK to Pakistan. This imbalance needs explanation.

    Third, the PR about the struggle for freedom in Kashmir is also not without exaggeration. The struggle had almost completely died out by the 1980s, with only a mild latent sentiment persisting. Yet the struggle was revived in the current form by militant appeals to religion.

    Fourth, Kashmiris currently insist that their struggle is peaceful. Many of those same Kashmiris who are claiming to be peaceful looked the other way or actively supported the massacre and eviction of several million Pandits purely because of religious differences.

    Fifth, and related to the second point, both Pakistan and India have spent too many resources trying to grab Kashmir. If India lets Kashmir go Pakistan would use religion to gain effective control over Kashmir the way it has over Afghanistan. It is very easy to do. Kashmiris wanting independence are in an impossible situation. Azadi is a euphemism for joining Pakistan, if not as a political entity then at least as a de facto vassal state. Kashmiri leaders cannot be blind to this.
