Death threats for law school exam complaints

You wouldn’t expect to receive death threats for complaining that an exam was unfairly administered, would you?  You wouldn’t expect to be abducted for telling school officials that a test paper had been leaked, would you?  Yet that’s exactly what happened to D.M. Thushara Jayaratne, a final-year student at the Sri Lanka Law College.

Thushara publicly complained last November that President Rajapaksa’s son (also a student at the College) had received preferential treatment during final exams, including being seated in an air-conditioned room with access to a computer.  On December 3, Thushara alerted school officials that the test paper for the Commercial Law II exam had been leaked and was being discussed by students before the exam.  Instead of taking action, College officials rejected his complaint.  He approached the Bribery Commission, which also turned him away.  Then he filed a police report.  The police questioned College officials about his complaint.

Thushara later told the police that after filing his police report, he had received calls from the College Office Manager threatening him repeatedly with abduction or death if he didn’t withdraw his complaint.  He went into hiding and didn’t complete his last two exams.  The threats decreased after his case was featured in numerous press reports.

But on Mar. 4, he was abducted by two men and held for nearly 12 hours before being released.  During his abduction, he was questioned about complaints he had made against the College Registrar and his statements to international organizations.

Harassment, intimidation and attacks against human rights defenders and others who expose abuses in Sri Lanka are not uncommon these days.  Thushara’s case is one more example.

I’m very concerned for Thushara’s continued safety.  Please write to the Sri Lankan government and ask them to immediately provide him with effective protection and hold accountable those responsible for his abduction.  Thanks.

    The Post following yours by Saleem explains exactly what I meant on my post – a useless cut and paste article with no individual sense of input.

    As I clearly mentioned, I do not justify what has happened (if it has happened, as I have a huge question about Jim MD's ability to gather information after the false cluster bomb article). It is a shame if such incident occurred.

    However, what I say is that there are many important and "Dying" issues in the world as Atrocities carried out by USA on Libya which needs to be ighligted at this point of time. Jim MD's pure intention is to sling mud at the GOSL and would try to make a mountain out of a mole hill at any given opportunity.

    I also hate the spineless double standards of AI and thoroughly believe that they are not fit to represent us (humans) due to the reasons of,

    1. Not taking action against USA for bombing and killing the innocent in Libya
    2. Not taking action against the terrorist Adela Balasingham who is in the UK
    3. Not taking action against Allied forces for killings in Afganisthan and Iraq

    In addition, if they justify what's happening in Libya today, they should also pressure the GOUSA to help the rebelian forces of Syria to oust their president.

    These spineless Swine do not have the balls to do so… AI is a very good example for a failed organization.

    I don't know many times this has to be repeated to people with learning difficulties. SL will not allow 'impartial' investigations into the Eelam Wars because the people who claim to be impartial are not.

    You can keep repeating the '40,000' dead but it remains untrue. The best estimate around 6-7,000 civilian deaths (via the UN) – a terrible figure – for which the LTTE is responsible because they used those civilians as shields against the Army assault. Everyone knows this, so please just stop repeating nonsense about 40,000 or 100,000 dead.

    India can do what it likes with its' own multiple insurgencies. It doesn't need lessons from Sri Lanka or anywhere else. Each insurgency is different. The rest if your standard whining, pious incantations and laments about the fate of the LTTE.

    Paradise regained in SL? No. It'll take another 2-3 generations to overcome the divisions, suffering and damage caused by this insurgency.

    Anyway, we're all looking forward to the big match tomorrow. India vs Sri Lanka for the Cricket World Cup. Oddly, AI have chosen not to repeat their disastrously ill-advised anti-SL cricket team, 'Play by the Rules' campaign as they did during the 2007 world cup.

    Colombo, April 1: A dissident Sri Lankan journalist has been arrested for allegedly threatening another man, but press freedom campaigners are of the opinion that it is a move to silence an independent voice critical about the Sri Lanka government.

    LankaeNews has been subjected to a number of threats and attacks in recent years. The organisation's office was set on fire in January, and a columnist for the website has been reportedly missing since over a year.

    Rupasinghe had said at that time that he suspected "a government hand" in the arson attack because the website had published many stories exposing corruption, "especially on the part of the government".

    He said that the website had received a lot of threats even before the arson attack.

    Last year, the chief editor of Lankaenews editor had fled the country after receiving threatening phone calls.

    Rajapaksa is attacking the opposition news organizations, opposition politicos and minorities.

    Recently, Minority Politico Yogeswaran said that Hindu temples in the eastern province of Sri Lanka are desecrated.

    He made this comment after viewing the destruction or stealing of Hindu God statues and other Hindu temple articles and other valuable items at Periyakallaa'ru a coastal village located 30 km south of Batticaloa city, Sri Lanka

    Are the Tamil children abducted to be raped and killed in the South ?

    Unidentified Sinhalese men from South last Sunday abducted a 13-year-old Tamil boy, K. Diluxon, from Uruththirapuram in Ki'linochchi.

    The boy managed to escape from his abductors while they parked their vehicle in Vavuniyaa.

    Meanwhile, a 17-year-old girl, Sangarapillai Maithrayi, from Vallaarai in Thenmaraadchi in Jaffna district was reported missing since Monday, according to complaints registered at Human Rights Commission in Jaffna.

    Human Rights activists in Jaffna said there have been several cases of abduction of under-age Tamil children in Vanni and expressed fear that elements from South were engaged in abducting children from the North through A9 Highway which is guarded by the occupying Sri Lankan military.

    On January 01, 2011, Tamil student was abducted with around 30 Tamil school children.

    Tamil National Alliance MP for Batticaloa, Pakiaselvam Ariyanethiran, Tuesday night told media that Sri Lankan forces were staging search operations in the three districts of Eastern Province to justify Colombo's “need” to extend the Emergency in the island. The Sri Lanka Army with the SL Police on Tuesday launched major cordon and search operation simultaneously in all the three districts of the Eastern province for the first time since the end of the war.

    SLA troops were again posted for duty along border villages Vadamunai, Ooththuch-cheanai and Punaanai areas and had threatened the Tamil villagers.

    The operation commenced Tuesday morning and had been continuing late in the day. Normalcy in the districts were disrupted due to the sudden deployment of large number of troops and police personnel in the operation, civil sources said.

    Large numbers of troops and police personnel were in Trincomalee port town and its suburbs stopping all vehicles and three wheelers and checking those traveling. Pedestrians were also stopped and checked by the SL forces.

    The SLA had set up road blocks along Badulla road and Colombo road.

    In Batticaloa district SLA sentries were set up along Paduvaankarai-Colombo highway and all vehicles were checked. Kokkaddich-choalai, Muthalik-kudaa and Makizhadith-theevu came under SL search operation.

    In Ampaarai district SLA troops with police personnel Tuesday morning commenced cordon and search operation in Thirukkoayil village including coastal areas along from Thampiluvil Kalaimaka'l Viththiyaalayamto Thirukoail police station.

    A similar operation is simultaneously being undertaken in Mullaiththeevu also.

    The operation is said to be following an alleged incident in which some SL troops who went on a boat are missing in the sea and only their boat came ashore.

    The SL troops came in armoured vehicles rounded up the entire coastal area.

    Newspaper journalists who wanted to cover the story were not permitted inside since Thursday morning.

    The war-like operation has evoked terror in the minds of the Tamil people in the north.

  70. Abductions of under-age Tamil youth escalate in the Tamil areas of Sri Lanka

    Are the Tamil children abducted to be raped and killed in the South ?

    Unidentified Sinhalese men from South last Sunday abducted a 13-year-old Tamil boy, K. Diluxon, from Uruththirapuram in Ki’linochchi.

    The boy managed to escape from his abductors while they parked their vehicle in Vavuniyaa.

    Meanwhile, a 17-year-old girl, Sangarapillai Maithrayi, from Vallaarai in Thenmaraadchi in Jaffna district was reported missing since Monday, according to complaints registered at Human Rights Commission in Jaffna.

    Human Rights activists in Jaffna said there have been several cases of abduction of under-age Tamil children in Vanni and expressed fear that elements from South were engaged in abducting children from the North through A9 Highway which is guarded by the occupying Sri Lankan military.

    On January 01, 2011, Tamil student was abducted with around 30 Tamil school children.

  72. Sri Lanka Armed forces want Emergency extended for colonizing East

    Tamil National Alliance MP for Batticaloa, Pakiaselvam Ariyanethiran, Tuesday night told media that Sri Lankan forces were staging search operations in the three districts of Eastern Province to justify Colombo’s “need” to extend the Emergency in the island. The Sri Lanka Army with the SL Police on Tuesday launched major cordon and search operation simultaneously in all the three districts of the Eastern province for the first time since the end of the war.

    SLA troops were again posted for duty along border villages Vadamunai, Ooththuch-cheanai and Punaanai areas and had threatened the Tamil villagers.

    The operation commenced Tuesday morning and had been continuing late in the day. Normalcy in the districts were disrupted due to the sudden deployment of large number of troops and police personnel in the operation, civil sources said.

    Large numbers of troops and police personnel were in Trincomalee port town and its suburbs stopping all vehicles and three wheelers and checking those traveling. Pedestrians were also stopped and checked by the SL forces.

    The SLA had set up road blocks along Badulla road and Colombo road.

    In Batticaloa district SLA sentries were set up along Paduvaankarai-Colombo highway and all vehicles were checked. Kokkaddich-choalai, Muthalik-kudaa and Makizhadith-theevu came under SL search operation.

    In Ampaarai district SLA troops with police personnel Tuesday morning commenced cordon and search operation in Thirukkoayil village including coastal areas along from Thampiluvil Kalaimaka’l Viththiyaalayamto Thirukoail police station.

    Thousands of occupying troops of Sri Lanka Army rounded up the Tamil village Uduththu’rai in Vadamaraadchi East and are engaged in brutal interrogations since Thursday early morning.

    Violent Sri Lanka Army soldiers broke the door down of every Tamil home and drag the semi –naked Tamil women, men and children out for brutal interrogation and severe beatings

    A similar operation is simultaneously being undertaken in Mullaiththeevu also.

    Vanni IDPs were recently resettled in both the places.

    The operation is said to be following an alleged incident in which some SL troops who went on a boat are missing in the sea and only their boat came ashore.

    The SL troops came in armoured vehicles rounded up the entire coastal area.

    Newspaper journalists who wanted to cover the story were not permitted inside since Thursday morning.

    The war-like operation has evoked terror in the minds of the Tamil people in the north.

Part and parcel of the registration process is of course, that each house is given a registration number which is made mandatory to have marked on both your front door and you’re the outside of our gate. In addition, a group picture is taken of the entire family, and one member of the family (usually the head of the household) is required to hold up a piece of paper with their respective registration number on it, for yet another photograph to be taken (much like a prisoner would). The worst part though, is that these people think it’s “normal.” They think that if this is what needs be done for them to live their day to day life in peace, then, so be it. All this rings okay with the rest of us citizens. It is for the greater good after all. That too is only the few who know that such humiliating, undignified “processes” are even being carried out.

    The State can randomly arrest parts of our “citizenship” on the faintest hint of suspicion, under a law that has been specifically designed to justify any unlawful acts conducted by the State, in order to uphold National Security, we see rationality in it. A part of our citizenship is still not permitted to return to their homes located within High Security Zones (HSZs) in the North, however, visitors to the North are permitted to go “sightseeing” inside those very HSZs.

    The State spends over one billion rupees on the Indian International Film Academy (IIFA) awards held in Colombo last year, but claim they have inadequate funds to house and feed their internally displaced citizenship around the country. It’s fine by the rest of the citizenship, because they got to see their favourite Bollywood Stars perform Live. Of course let’s not forget that a Star or two were taken on a goodwill mission “behind the wires” too, so it’s not all bad.

    Similarly, the State has incurred hundreds of millions of dollars on a Port in the Incumbent’s hometown, Hambantota, which has been allegedly refused maritime insurance by Lloyds, London. Furthermore, the State imported 3 power train sets (each of which costing 3.5 million US$), of a fleet of 20 from India, one of which was tried out and failed on it’s first run due to complications including inadequate power supply. Irrespective of this rather pricey “hitch” though, it seems like the Government is planning to go ahead with the entire purchase without as much as a trial period to see if these trains are conducive to our railway system In yet another display of waste, our dear incumbent has successfully managed to garner a 300 million US$ arms loan from Russia, to safeguard ‘Post-War’ Sri Lanka, pushing us as a country, further and further into debt.

    Sri Lankan-born German senator Ian K. Karan has initiated several projects to uplift the infrastructure facilities of schools at his birth place in Point Pedro, Jaffna.

    Senator Karan is also a former State Minister of Economic Affairs and Labour in Hamburg, Germany.

    He handed over a schoolbus worth Rs. 1.8 million to Methodist Girls' High School, Point Pedro at a ceremony at the German Embassy premises in Colombo last week.

    German Ambassador Jens Plotner noted that the Senator's gesture of reinvesting in his home town set an example for other Sri Lankan Tamils living abroad, who were eager to give back to their communities.

    The Methodist Girls' School is a leading girls' school in the Northern Province. "We have over a 1,000 students in our school and each year our students participate in various competitions and tournaments across the Jaffna peninsula. But until the new bus was received we had to spend a lot of money on travelling," said Principal J/Methodist girls' High School, Point Pedro, S. Suntharesan.

    Why approaching the 2 year mark since the end of the war, people, mostly in the Vanni, are still being registered door-to-door by the military? Part and parcel of the registration process is of course, that each house is given a registration number which is made mandatory to have marked on both your front door and you’re the outside of our gate.

    Illegal excavation of limestone threatens ecology of Jaffna

    Threatening the entire groundwater and fragile ecology of Jaffna peninsula, a private Sinhalese company is engaged in the illegal excavation of limestone in the High Security Zone (HSZ) while Rajapaksa government refuses to reveal details of this enterprise in the area from Maaviddapuram to Keerimalai where the uprooted Tamil residents have not been allowed to resettle for the past twenty years.

    The indiscriminate excavation of limestone in a 4 sq km area at depths of nearly 40 feet has already caused seepage of sea water and it is feared the area becoming submerged.

    The underground channels that bring in freshwater to the innumerable aquifers of the peninsula, have an underneath entry into sea adjacent to the locality of the quarries. It is obvious how indiscriminate quarrying and the possibility of seawater coming inside can affect the potable water of the masses.

    The houses are being constructed in a newly declared SLA High Security Zone, strictly out of bounds for local Tamils.

    Hundreds of container vehicles bring the construction material for the permanent houses and heap them along road. These materials are transported in SLA trucks to the construction site so as to prevent any one seeing the work in progress.

    Meanwhile, the uprooted Tamil civilians resettled near the area are left on their own abandoned by the Sri Lanka government to suffer in makeshift structures on bare lands without any basic facilities.

The failure of ACF to follow international guidelines of procedures (which then UN Under-Secretary Sir John Holmes kindly sent me), their refusal to testify properly before the Commission (indeed their hasty flight when hard questions were being asked) suggests a conspiratorial element too in the effort to stampede the world into believing Sri Lankan security forces were responsible. It is noteworthy that the contribution of the then Head of the SLMM involved breaching the provisions of his contract, as was granted by his successor, General Lars Solvberg, whom I found admirably conscientious.

    It is sad then to find the US Department of State falling in with this strange conspiracy, and not rather using its moral authority to get ACF to pay proper compensation to the relations of the victims it had sent into danger. But, at the same time, we must realize that this sort of attack is made easier by our failure to make public the findings of the Commission. It is true that, from the perspective of an informed but inexpert observer, I believe that in one of the cases considered by the Commission, individuals behaved improperly. If this is the case, it needs to be addressed. However, in most if not all of the other cases, I believe no blame can be attached to government forces, and that position will be less contentious if we do admit to errors where they have occurred, and that internal mechanisms are perfectly capable of addressing such problems.

    Similarly, we should ensure that there is proper closure on the Mahanama Tillekeratne Commission to look into disappearances etc, and we need to pursue more carefully the investigation into the murder of Lasantha Wickramatunga. I have pointed out previously that those who immediately found Defence forces guilty were in fact inhibiting investigation, and that the approach of the Civil Rights Movement was much more positive: that made it clear, if I recollect aright, that investigation was important, and that if such investigation led nowhere, it suggested a lack of professionalism on the part of the police. If this is the case, we cannot continue complacent, but must ensure remedial action. Similarly, there must be more concerted effort with regard to investigation of a killing which the US Report links to Member of Parliament Duminda Silva. Naming him here, and adding a reference to a rape case, again seems to indicate the political purpose of the report, though in this case too Government should ensure a more professional approach on the part of the police.

This is possibly because we have not put down our refutations in writing officially. I have made a detailed critique, but unfortunately I have no official status, and indeed my capacity to respond to Alston was vitiated by officials of the Ministry of External Affairs way back in 2009. Had they substituted someone more effective, I would have been delighted, but it seems that this matter has only been dealt with verbally, which is what permits continuing authority to Alston’s highly prejudiced approach – including his belittling of the findings of his experts, that throw doubt on the video.   134. SL asylum seekers in tents

    The Australian Immigration Department is unable to confirm how long asylum seekers at a far north Queensland detention centre will be housed in tents.

    There are 570 detainees from Afghanistan and Sri Lanka at the Scherger RAAF base near Weipa on western Cape York. A temporary detention centre was set up in October to house 300 detainees to relieve pressure on the Christmas Island facility.

    The Immigration Department recently announced Scherger would stay open until at least the middle of next year. A spokesman has confirmed some of the detainees are staying in marquee-style accommodation. He says it is a short-term measure but cannot say when the situation is likely to change.

Seven cases are cited of deaths in police custody, one involving four persons in Trincomalee, and another two in Moratuwa. These are disgraceful, and they should not only be investigated thoroughly, but action should be taken against the perpetrators if unnecesssry violence was used. In only three of the instances are there even allegations of provocation, and those too do not seem entirely plausible.

    We know that all over the world police can sometimes react violently to what they perceive as criminality. It is not excuse however to cite precedent. We all know for instance of the Rodney King incident in the United States, and that the perpetrators were acquitted, despite clear visual evidence. However they were brought to trial, which at least provides a deterrent against further such abuses. We in Sri Lanka must ensure that action is taken, and it is sad that it is left to the Americans to continue to maintain records of such cases. This also shows up the selectivity of journalists and others who claim to be defenders of Human Rights. Though there was dramatic reporting of, for instance, the case of the two youngsters killed in Angulana, there has been little follow up. I believe some action was taken at the time, but there has been little attention to follow up. Equally appalling is the lack of concern about what is reported as ‘the March 2009 deaths of four persons in the Trincomalee area who were in police custody in connection with the killing of a schoolgirl.’

    Unfortunately the reality is that most so-called Defenders of Human Rights are more concerned with the political mileage they can get from their pronouncements than with the victims. Though it should not blind us to the real concerns raised by the US report, the same seems to be true of its American authors. In addition to clearly being dependent on local observers they will not identify, though they anxiously assert several times that these are independent, they engage in some sleight of hand that reveals their predilections. Two of the instances they note with regard to what they call ‘Arbitrary or Unlawful Deprivation of Life’ (and six of the eleven individuals killed) relate to 2009 rather than 2010.

    Equally significantly, mixed in with these are assertions about alleged killings by government supporters. A long paragraph points fingers at Pillaiyan and Karuna, erroneously lumping them together in the TMVP, as well as at Douglas Devananda. Only one example is cited for all of this, the death on December 31st 2010 of ‘Ketheeswaran Thevarajah’. The paragraph that is used for justification of the vicious attack on government ministers who repudiated terrorism and entered the democratic process is worth citing in full – ‘On December 31, unidentified armed men entered the home of Ketheeswaran Thevarajah near Jaffna and killed him. He recently had posted photos of illegal sand excavation on his Facebook profile. Many local Jaffna residents suspect EPDP subsidiaries were illegally mining sand in the Jaffna region, causing environmental damage.’

    That this paragraph is the sole justification for denigration of the most solid opponents of LTTE terrorism makes clear what is obviously a forceful element in the inspiration behind the report. It is desirable therefore that our Ministry of External Affairs call in the American Ambassador and formally but politely raise questions about the methodology involved. She herself is not I believe a supporter of terrorists, even those masquerading as recent converts to democratic practice, but what I hope is her less prejudiced approach has been set aside in such paragraphs.

    What is particularly outrageous about the manner in which the report is written is that it unequivocally associates Pillaiyan and Karuna and Devananda with criminal characteristics. Though the paragraph notes that the number of what is termed extra-judicial killings dropped significantly, the manner in which, with a twisting of language which would have impressed Orwell, government ministers are likened to criminals is vicious, and should be taken up by the Ministry of External Affairs.

  138. Complaints about the disappearance of 50 residents in the Jaffna District between the period of end February till end March have been reported to the Jaffna Police. The Police have recovered 12 dead bodies out of those disappeared.
    People are disturbed at how the disappearances take place when there is one security officer for every 13 residents in Jaffna. While there are 670,000 persons living in the Jaffna District, there are over 50,000 security forces personnel and police officers assigned to the district.
    A senior police officer said that several armed groups were responsible for the disappearances.

    UN served a ploy to surrender killings
    Around 18 hours before the surrender of the LTTE Political Head B Nadesan and other civil officials of the LTTE that ended in their killing by the Sri Lanka Army, the UN officials served in the island met in Vavuniyaa and made plans to receive them on behalf of the UN. The UN officials were very well aware of who were coming to surrender, said a high-ranking UN worker who was involved in the arrangements to TamilNet on Monday. All the UN officers who served in the island at the time of the war are either no more in UN service or have left the island. The UN was used as a ploy in arranging and enacting the ‘surrender’ and then to kill the LTTE officials, Tamil political observers said. Vijay Nambiar, chief of staff to Secretary-General Ban Ki-moon, was in Colombo at the time.

However, in most if not all of the other cases, I believe no blame can be attached to government forces, and that position will be less contentious if we do admit to errors where they have occurred, and that internal mechanisms are perfectly capable of addressing such problems.

    Similarly, we should ensure that there is proper closure on the Mahanama Tillekeratne Commission to look into disappearances etc, and we need to pursue more carefully the investigation into the murder of Lasantha Wickramatunga. I have pointed out previously that those who immediately found Defence forces guilty were in fact inhibiting investigation, and that the approach of the Civil Rights Movement was much more positive: that made it clear, if I recollect aright, that investigation was important, and that if such investigation led nowhere, it suggested a lack of professionalism on the part of the police. If this is the case, we cannot continue complacent, but must ensure remedial action. Similarly, there must be more concerted effort with regard to investigation of a killing which the US Report links to Member of Parliament Duminda Silva. Naming him here, and adding a reference to a rape case, again seems to indicate the political purpose of the report, though in this case too Government should ensure a more professional approach on the part of the police.

    Just before that final paragraph, the US report makes reference to the 2009 Channel 4 video, and refers to Philip Alston’s argument that this was authentic. Though the report notes contradictions that have emerged with regard to the video and what was claimed to be its continuation, shown in November 2010, and also the Government evidence that the video was a fabrication, it makes no reference to our arguments against Alston’s conclusions based on his own chosen experts. This is possibly because we have not put down our refutations in writing officially. I have made a detailed critique, but unfortunately I have no official status, and indeed my capacity to respond to Alston was vitiated by officials of the Ministry of External Affairs way back in 2009. Had they substituted someone more effective, I would have been delighted, but it seems that this matter has only been dealt with verbally, which is what permits continuing authority to Alston’s highly prejudiced approach – including his belittling of the findings of his experts, that throw doubt on the video. I hope that, since this along with the White Flag story are the main components of allegations against our forces, we will show how riddled they are with contradictions and malice.

    Can you please explain to us in your own terms, what you think of the barbaric acts carried out by the LTTE ?? (The side you are trying to defend)
