The Cancer of Democracy

The take-no-prisoners approach to counterinsurgency adopted by the Sri Lankan government in 2009 was hailed in many corners as evidence that letting the military off the leash was more effective than a nuanced strategy of political engagement.

As disturbing stories emerged of Sri Lankan military and paramilitary units executing prisoners, silencing civil society critics and displaying a cavalier disregard for civilian casualties these were dismissed by government apologists as a price worth paying to secure democratic rule on the island.

In October last year the Obama administration even went so far as to brief the Sri Lankan Attorney General on the Military Commission system operating at Guantanamo. Sri Lanka is considering the Commissions as a possible model for Special Tribunals to try 12,000 potential LTTE suspects.

Then last month the Sri Lankan government arrested General Sarath Fonseka – military architect of the aggressive military strategy that led to the defeat of the LTTE and the death of Tiger leader Velupillai Prabhakaran.

General Fonseka had been the main challenger of President Mahinda Rajapaksa in the January 2010 general election and it seems pretty apparent that the Sri Lankan regime is determined to send a strong message to future challengers that serious political opposition will not be tolerated.

The arrest of General Fonseka, the internment of Tamil civilians in poorly run camps, and the disappearance of human rights activists and journalists from the streets of Colombo are all part of the same pattern and spell disaster for the future of one of the oldest democracies in Asia.

One aspect of torture and human rights abuse often ignored in the counterterrorism debate is the impact that draconian and even illegal tactics have on the fabric of the society using them.

In the 1960s the French journalist Pierre Vidal-Naquet famously described torture as “the cancer of democracy” and chartered how counter terror and the use of water boarding and electric shock treatment on terrorist suspects in Algeria eroded the democratic values of the French military.

As French forces got sucked deeper and deeper into the conflict elite frontline units were called upon to break more and more of the taboos of civilized society. Democratic control began to break down as soldiers began to see themselves as being above the law.

Ultimately, as the civilian government moved towards a withdrawal from Algeria, French generals mounted a coup in Algiers and established their own terrorist movement, the Organisation de l’Armée Secrète (OAS), that declared war on the French government and came close to assassinating French President and national hero Charles de Gaulle.

Illegal tactics like torture and indefinite detention are not consequence free for those who use them. They erode values, discipline and ultimately even relatively stable democracies. The truth is that in the real world you can’t destroy the village to save it. That approach just leaves you with a pile of rubble.

    A large number of Tamil women detainees are being isolated and starved to magnify the physiological torture administered with a typical Sinhalese cruelty on daily basis.

    Also the Tamil women prisoners human rights are viciously violated in Sri Lanka because detaining them them without producing them in a Court of law within 24 hours.

    According to the Article 13 of the Sri Lankan Constitution, the supreme law of the country, a suspect or person taken into custody has to be produced before a Court of law within 24 hours.

    Last year, the whole world watched with bewilderment how Colombo silenced the five doctors, the key witnesses to its war crimes, after being emboldened by the abetment of India, China and others in bailing it out from condemnation at the UN Human Rights Council.

    A few days back, some people in Mannaar were interrogated by Sri Lankan military, which accused them of registering details about war crimes with diaspora activists visiting India.

    There seems to be an ongoing orchestrated effort involving 'governments' exploiting former LTTE members in captivity in erasing evidences of war crimes, alleged the Tamil Nadu media sources.

The whole problem is Rajapakse’s setting the sights of a lonstanding foothold in the Sri lankan power base after eliminating the tigers .In my view sudden emergence of Fonseka factor was totally unexpected and has taken the rajapakses by surprise.Allegation of war crimes have further complicated the matters.This is why government is playing mayhem and seemed to prepared to do anything to preserve the powerbase. Fonseka whether we like or not will not be released that easily unless there is a huge public outcry.Rajapakses are too shrewd and ranil will be a mere spectator.

    Sri Lanka Army officials are forcing Tamil children from the the north and east of Sri Lanka to be their free domestic servants in their houses.

    The concerned citizen in Colombo said she witnessed ‘couple of them being employed in army officials houses’ and went on to confirm further that ‘the abuse is widespread among high ranking officials’.

    The source also said that ‘a young Tamil girl engaged by an army official in Colombo had some injuries to her hands and legs’.

    Could this was due to beatings in the Sri Lankan Army official, the owner of the house ?

    A Tamil woman from Sri Lanka held in the Refugee camp for Sri Lankans in Karoor district in Tamil Nadu died Sunday night in Karoor government hospital where she had been admitted two weeks ago when she had set herself ablaze unable to bear being sexually molested by three Tamil Nadu policemen. Ms. Kumar Pathmathevi, 28, had said in her statement to a feminist human rights activist that the policemen took her to a private house and molested her instead of taking her to the police station to be interrogated about her husband Kumar who was wanted in a homicide case. Various civil organizations in Jaffna peninsula as well as in Tamil Nadu are in uproar against the police cremating the body of Pathmathevi, against the law of the country.

    The three policemen who had sexually molested had warned Pathmathevi not to divulge the incident to anyone and that they will shoot dead her husband Kumar if she did so, according to Pathmathevi’s statement given from her death bed to the human rights activist woman.

    The burning of Pathmathevi’s remains which should have been interned by the police has raised suspicion that the three policemen are guilty of the offence alleged.

    I thinkTamilnadu, should not not imprisoned Sri Lankan Tamils in concentration camps for 10 years an brand all of them as terrorists because they seek shelter as a refugees
